WHEREAS, a change in federal law to require local law enforcement agencies to report <br />each custodial death to the United States Department of Justice and to provide for review and <br />independent investigation of such deaths by the Department, would help restore public confidence <br />in law enforcement and expose any patterns of discriminatory treatment of people based on their <br />socio-economic status, the color of their skin, their gender identity or sexual orientation, their <br />immigration status, or their religious beliefs; and <br />WHEREAS, the deployment and use of surplus military hardware, vehicles, and weaponry <br />against United States citizens, including those engaged in the exercise of their rights under the first <br />amendment to protest and to petition the government for the redress of grievances, is abhorrent to <br />people who enjoy living in a constitutional democracy; and <br />WHEREAS, a change in federal law could prohibit the transfer, sale, or donation of <br />military hardware, vehicles, and weaponry to local law enforcement agencies and deter use of <br />them use against civilians including those who choose to peaceably assemble, march, and protest. <br />THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br />would: <br />PART 1. The City Council urges the United States Congress to adopt legislation that <br />a. Require local law enforcement agencies to report all deaths of citizens <br />resulting from interactions with police or while in police custody to the United. States <br />Department of Justice; <br />b. Require the United States Department of Justice to review each report of a <br />custodial death of a citizen at the hands of local law enforcement officers and conduct an <br />investigation to determine if the death resulted from the unnecessary or improper use of <br />force and whether the local law enforcement agency has a pattern of discrimination in the <br />use of force against certain individuals or groups, including people of color; and <br />C. Prohibit the United States military from transferring, selling, or donating <br />military hardware, vehicles, or weapons to local law enforcement agencies for use against <br />civilians. <br />PART 2.
