4. Consider adoption on second and final reading of Ordinance 2009-56, amending Section • 5 of Ordinance No. 2009-12 to grant the developers of the proposed Purgatory Creek Apartments on Hunter Road an extension of time from September 30, 2009 to June 30, 2010 to obtain TXDOT approval of the size and location of a curb cut and construction plans for a center turn lane and deceleration lane on Hunter/Hopkins Road and to obtain final approval and recording of a subdivision plat and approval of a site preparation permit as conditions precedent to the effectiveness of a proposed amendment to the official zoning map of the City to change the base zoning from "GC" General Commercial District to "MF-18" Multi-Family District for a 12.743 and 9.761 acre, more or less, tract of land out of the JM Veramendi Survey No. 1, Abstract No. 17, and a proposed land use plan and proposed development standards for the Purgatory Creek PDD; including procedural provisions; and providing an effective date. Dianne Wassenich, 11 Tanglewood, San Marcos, reminded the City Council that the proposed apartments are located below an earthen flood control dam. There is also an issue of the vanity lake which will be filled by a well and evaporating precious aquifer water. The size of the lake is of concern if it used for retention or runoff. Another issue is the Purgatory Bridge needs to be high enough that children can get from the surrounding neighborhoods to the school. A pathway is needed there. The Purgatory Bridge will determine whether TXDOT will approve access to Hunter Road. We can't have kids crossing that street even with a light. The 500 year flood plain comes up 5 feet on the CVS Pharmacy, but if it floods into homes while people are sleeping it would be disastrous. MOTION: Upon a motion made by Councilmember Couch and a second by Councilmember • Terry, the City Council voted four (4) for and two (2) opposed, with Councilmembers Jones and Thomaides voting against, to adopt Ordinance 2009-56 on the second and final reading, as previously captioned. The motion carried unanimously. 5. Question and answer session with press and public. There were no questions. 6. Adiournment. MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember Thomaides, the City Council voted six (6) for and none (0) opposed, to adjourn the regular session of the San Marcos City Council at 8:40 a.m. on Tuesday, September 29, 2009.
