0 RESOLUTION 2009 - 131R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE FILING OF A GRANT <br />APPLICATION WITH THE CAPITAL AREA COUNCIL OF <br />GOVERNMENTS FOR A FY 2010/2011 REGIONAL SOLID WASTE <br />GRANTS PROGRAM GRANT; PLEDGING THAT IF THE CITY <br />RECEIVES A GRANT AWARD IT WILL COMPLY WITH THE GRANT <br />REQUIREMENTS OF CAPCOG, THE TEXAS COMMISSION ON <br />ENVIRONMENTAL QUALITY AND THE STATE OF TEXAS; <br />AUTHORIZING THE CITY MANAGER TO ACT ON BEHALF OF THE <br />CITY IN ALL MATTERS RELATED TO THE GRANT APPLICATION <br />AND ANY SUBSEQUENT GRANT AGREEMENT AND DECLARING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. The Capital Area Council of Governments ("CAPCOG") is directed by the Texas <br />Commission on Environmental Quality ("TCEQ") to administer solid waste grant funds for the <br />implementation of CAPCOG's adopted regional solid waste management plan <br />2. The City is qualified to apply for grand funds under the Request for Applications <br />• process. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The filing of a grant application with CAPCOG for FY 2010/2011 <br />Regional Solid Waste Grants Program funding is approved. <br />PART 2. The City Manager, Rick Menchaca is authorized to request grant funding <br />under the CAPCOG Request for Applications of the Regional Solid Waste Grants Program and <br />act on behalf of the City in all matters related to the grant application and any subsequent grant <br />contract and grant project that may result. <br />PART 3. If the project is funded, the City will comply with the grant requirements <br />of CAPCOG, TCEQ, and the State of Texas. <br />PART 4. The grant funds and any grant-funded equipment will be used only for the <br />purposes for which they are intended under the grant. <br />PART 5. The City's activities regarding any project resulting from this application <br />will comply with and support the adopted regional and local solid waste management plans <br />• adopted for the geographical area in which the activities are performed.
