clearly detailed in the quarterly progress reports in order to assure CAPCOG that the activities <br />are not prohibited under Attachment D Article 2 of this Contract (relating to Supplemental <br />Funding Standards). The SUBCONTRACTOR shall comply with any reasonable request by <br />CAPCOG for additional information on activities conducted in order for CAPCOG to <br />adequately monitor the SUBCONTRACTOR's progress in completing the requirements of and <br />adhering to the provisions of this Contract. <br />(c). The SUBCONTRACTOR will certify in writing to CAPCOG through a final progress report, the <br />satisfactory completion of all activities and deliverables required under this Contract. The <br />final progress report shall consist of the forms described in Section A of this Article 4. <br />(d). The SUBCONTRACTOR shall maintain the information required by the forms listed in Part (a) <br />of this Section so that a follow-up results report can be prepared. The SUBCONTRACTOR <br />shall provide CAPCOG with a follow-up Progress Reporting Form to be due approximately <br />September 2012 so that CAPCOG can report to the TCEQ the results of the projects funded <br />under this Contract. <br />(e). The SUBCONTRACTOR'S failure to comply with the requirements of this Article shall <br />constitute a breach of this Contract. <br />M. The SUBCONTRACTOR shall maintain documentation on the results of the project activities <br />for the life of the program or activity. <br />(g). The reporting requirements of this Article 4 survive the ending or early termination of this <br />Contract. <br />Article 5: Monitoring Requirements <br />(a). CAPCOG may periodically monitor SUBCONTRACTOR for: <br />1. The degree of compliance with the terms of this Contract, including compliance with <br />applicable rules, regulations, and promulgations referenced herein; and <br />2. The administrative and operational effectiveness of the project. <br />(b). CAPCOG shall conduct periodic analysis of SUBCONTRACTOR'S performance under this <br />Contract for the purpose of assessing the degree to which contractual objectives and <br />performance standards, as identified in this Contract or as subsequently amended, are achieved <br />by SUBCONTRACTOR. <br />Article 6: Title To and Management of Real Property and Equipment <br />(a). Subject to the obligations and conditions set forth in this Agreement, title to real property and <br />equipment (together hereafter referred to in this Article as "property") acquired under this <br />Agreement by the SUBCONTRACTOR will vest upon acquisition or construction in CAPCOG <br />or the SUBCONTRACTOR respectively. <br />CAPCOG FY2010 Solid Waste Interlocal Contract 8
