3. Normandy's Responsibilities and Standards of Performance <br />a Normandy shall maintain registration • <br />y proper as a lobbying firm under applicable <br />State and Federal laws and shall comply with all applicable local, state and federal laws and <br />regulations, including without limitation, those relating to ethics, political contributions and gifts <br />to candidates and public officials. The performance of all services by Normandy under this <br />Agreement will be by persons appropriately licensed or registered when required under local, <br />state and federal laws. <br />(b) Henry Bonilla shall be the primary point of contact and will oversee the provision <br />of the Services by Normandy. Christine Pellerin shall be as a secondary contact. The City, <br />however, may communicate with other representatives of Normandy as appropriate, who may be <br />working on specific projects related to the Services. Normandy may designate another primary <br />point of contact only with the approval of the City. <br />(c) In performing the Services, Normandy will use that degree of care and skill <br />ordinarily exercised for similar services by firms that specialize in providing the types of services <br />involved under this Agreement. <br />(d) Any provisions in this Agreement pertaining to the City's review, approval and <br />/or acceptance of written materials prepared by Normandy in connection with this Agreement <br />will not diminish Normandy's responsibility for the materials. <br />(e) Normandy will perform all Services in coordination with the City. Normandy • <br />will advise the City of data and information Normandy needs to perform the Services, and <br />Normandy will communicate with City representatives at mutually convenient times to assemble <br />this data and information. <br />(f) Normandy shall provide at least monthly, but more frequently as appropriate, <br />written reports regarding significant federal legislative and regulatory activities within both the <br />legislative and executive branches of the federal governments affecting the City's interests. <br />(g) Normandy shall provide weekly written status reports of its activities related to <br />the Services. <br />(h) In performing the Services, Normandy will comply with all local, state and <br />federal laws. <br />(i) It is anticipated that during the term of our engagement, The Normandy <br />Group will be privy to data or information which is confidential or proprietary to the City of San <br />Marcos. We agree that such confidential information furnished or disclosed to The Normandy <br />Group shall be maintained in confidence by us, and shall not be disclosed to any person or entity <br />except as authorized in writing by the City of San Marcos. Moreover, The Normandy Group <br />agrees to refrain from accepting or conducting assignments from any person or organization <br />during the term of this engagement which would conflict with or impair an unbiased <br />performance of the consulting services or other duties under this engagement.
