<br /> 28.. <br />Regular Meeting March 25, 2002 Page 9 <br /> TRANSPORTATION; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS <br /> AMENDMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> APPROVING THE TERMS AND CONDITIONS OF AN AMENDED AGREEMENT BETWEEN <br /> THE CITY AND SOUTHWEST TEXAS STATE UNIVERSITY FOR ATTACHMENT OF LINES <br /> TO UTILITY POLES; AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br /> AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br />(Mr. Mihalkanin and Ms. Hughson abstaining to the preceding Resolution <br />disclosure affidavits-business entity filed.) <br />Mayor Chiu introduced an Executive Session pursuant to the Government <br />Code, Section 551.071, to seek the City Attorney's advice regarding <br />pending litigation, contemplated litigation, a settlement offer, or a <br />matter involving attorney-client privilege (Weatherford vs. City of San <br />Marcos; Gary vs. City of San Marcos; election laws); Sections 551.072 and <br />551.073, to discuss the purchase of real property (Hunter Road area); <br />Section 551.074, to discuss the duties of public officers (Planning and <br />Zoning Commission Members); and Section 551.086[76th Leg. Ch. 1319]), to <br />discuss commercial or financial information the City has received from a <br />business prospect with which the City is conducting economic development <br />negotiations, or to deliberate the offer of a financial or other incentive <br />to such a business prospect (Outlet Mall area; Posey Road area). Mr. <br />Mayhew moved the Council adjourn into Executive Session at 10:55 p.m. and <br />Ms. Tatum seconded the motion, which passed unanimously. <br />Mr. Mihalkanin moved the Council reconvene at 12:30 a.m. and Ms. Tatum <br />seconded the motion, which passed unanimously. <br />Mayor Chiu introduced a discussion regarding Downtown Parking. Due to the <br />length of this meeting, the City Council delayed the discussion and <br />requested it be placed on the April 8, 2002 agenda. <br />Mayor Chiu introduced a discussion regarding the City Council's Report. <br />Mr. Mihalkanin stated he would like a discussion and give direction to <br />staff item placed on the April 8, 2002 agenda regarding Multi-Family <br />housing built by non-profit organizations and then taken off the tax roll. <br />Mr. Cox stated for the April 8, 2002 agenda he would like the Youth <br />Commission Ordinance to be reconsidered. Ms. Hughson stated she would <br />like a discussion item on the April 8, 2002 agenda regarding Dr. Rogers' <br />proposal of parkland. Ms. Tatum stated she obtained a copy of the <br />National League of Cities 2002 Federal Legislative Priorities from the NLC <br />Conference she attended. She stated she would like to discuss the City of <br />San Marcos Human Development Commission becoming more aligned with the <br />NLC's Human Development Steering Committee at the Regular Meeting April 8, <br />2002. <br />Mayor Chiu introduced a discussion regarding Executive Session items. <br />Mayor Chiu stated it was the consensus of Council to direct City staff to <br />
