RESOLUTION NO. 2020-177R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS DIRECTING THE CITY MANAGER TO BEGIN <br />NEGOTIATION OF AN INTERLOCAL AGREEMENT WITH HAYS <br />COUNTY THAT PROVIDES FOR THE REPAIR AND REHABILITATION <br />OF CAPES'S DAM AND THE MILL RACE ON THE SAN MARCOS <br />RIVER; AND DECLARING AN EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The city manager is hereby directed to begin negotiation of an interlocal <br />agreement with Hays County that provides for the repair and rehabilitation of Cape's Dam and <br />the mill race on the San Marcos River. <br />PART 2. The negotiated agreement should include provisions for preserving the <br />historic values of the darn and mill race, protecting endangered aquatic species, and making <br />this area of the San Marcos River safe and attractive for recreational users. <br />PART 3. The negotiated agreement should address the process to be followed to <br />obtain community input regarding the design of public improvements and clearly define the <br />responsibilities of the parties for obtaining and complying with permits, securing funding, <br />awarding and managing construction contracts, and maintaining the dam, mill race, and any <br />other improvements following completion of construction. <br />PART 3. The city manager shall make a report and presentation to the city council <br />regarding the progress of the negotiations at a regular council meeting within 60 days from the <br />date of this resolution. <br />PART 4.
