I <br /> ARTICLE 1: INTRODUCTION DIVISION 2: PURPOSE AND INTENT <br /> Section 1.1.2.1General <br /> DIVISION 1: REFERENCE;AUTHORITY;CONSISTENCY;EFFECTIVE <br /> DATE This Development Code was adopted for the purposes of promoting <br /> the public health, safety, morals and general welfare, and protecting <br /> Section 1.1.1.10fficial Name and preserving places and areas of environmental, historical, <br /> This Subpart B of the San Marcos, Texas, City Code, as may <br /> cultural and/or architectural importance and significance within the <br /> city limits. <br /> be amended, shall be officially known and cited as the "Land <br /> Development Code of San Marcos, Texas". It may be referred to Section 1.1.2.2Zoning Districts <br /> as the "Development Code" or herein simply, "this Development <br /> Code." The districts established under and pursuant to this Development <br /> Code have been designed to lessen the congestion in the streets,to <br /> Section 1.1.1.2Authority secure safety from fire, panic and other dangers,to ensure adequate <br /> light and air,to prevent the overcrowding of land and thus avoid <br /> This Development Code is adopted pursuant to the statutory undue concentration of population, and to facilitate the adequate <br /> authority conferred by and pursuant to the Texas Local Government provision of transportation,water supply, wastewater treatment, <br /> Code, as amended, and pursuant to and in accordance with schools, parks and other public requirements, and are established <br /> the City's Comprehensive Plan entitled "Vision San Marcos -A with reasonable consideration for, among other things,the character <br /> River Runs Through Us," adopted April 16, 2013, as amended of each district and its suitability for the particular uses specified, <br /> ("Comprehensive Plan"). This Development Code implements the conserving the value of buildings and environmentally sensitive <br /> Comprehensive Plan. features, and encouraging the most appropriate use of land <br /> Section 1.1.1.3Consistency with Comprehensive Plan throughout the City. <br /> The City Council has determined that this Development Code is <br /> consistent with the Comprehensive Plan. <br /> Section 1.1.1.4Effective Date <br /> This Development Code, as may be amended, shall take effect on <br /> April 17, 2018. <br /> (Ord. 2020-60, 9-1-20; Ord. No. 2019-45, 12-17-19) <br /> Section 1.1.1.5Amendment & Restatement of Previous <br /> Land Development Code and Smartcode <br /> As of the effective date,this Development Code shall supersede, <br /> amend and restate in its entirety the Land Development Code <br /> previously adopted as Subpart B on December 13, 2004, as <br /> amended, and the San Marcos Smartcode previously adopted as <br /> Subpart C, of the San Marcos, Texas, City Code on May 3, 2011, as <br /> amended. <br /> 1:2 San Marcos Development Code Amended:September 1, 2020 <br />
