(e) the cost of property casualty and public liability insurance; including any insurance
<br />deductible charged to or required to be paid by the Authority;
<br />(f) all costs incurred in litigation involving or relating to the Project; and
<br />(g) any and all other reasonable and necessary costs and expenses, including out-of-
<br />pocket expenses, incurred by the Authority attributable to the Project or the Bonds, whether
<br />enumerated above or not and whether or not included in the definition or as a part of Project Costs.
<br />"Original Project" means the costs to finance, refinance, acquire, and construct treatment
<br />facilities, water supply pipelines, booster pumps, other appurtenances, and necessary easements
<br />and other interests in land, including water rights acquisitions pursuant to the Original Contract to
<br />serve the Original Participating Members.
<br />"Outstanding Bonds" means the Series 2003 Bonds, Series 2005 Bonds, and Series 2017
<br />Bonds that are currently outstanding in the aggregate principal amount of $10,800,000.
<br />"Participating Member(s)" means certain of the Original Participating Members and all
<br />Additional Participating Members from time to time subject to this Amended and Restated
<br />Contract.
<br />"Participating Members Operation and Maintenance Expenses" means that portion of the
<br />Operations and Maintenance Expenses allocated to the Participating Members pursuant to Section
<br />5.01 herein.
<br />"Parties" means the Participating Members, the Authority, the City, and all Additional
<br />Participating Members from time to time subject to this Amended and Restated Contract.
<br />"Permitted Liens" means:
<br />(a) Minor irregularities, charges, liens, encumbrances, defects, easements, licenses,
<br />rights-of-way, servitudes, restrictions, mineral rights, and clouds on title which, in the opinion of
<br />counsel to the Authority, do not materially impair the use of the Project for the purposes for which
<br />it is designed.
<br />(b) Easements for roads (as used in this Amended and Restated Contract, the term
<br />"roads" shall include, without limitation, streets, curbs, gutters, drains, ditches, sewers, conduits,
<br />canals, mains, aqueducts, aerators, connections, ramps, docks, viaducts, alleys, driveways, parking
<br />areas, walkways, and trackage), utilities (which for purposes of this Amended and Restated
<br />Contact shall include, without limitation, water, sewer, electricity, gas, telephone, pipeline,
<br />railroad, and other collection, transportation, light, heat, power, and communication systems) and
<br />similar easements and other easements, rights-of-way, rights of flowage, flooding, diversion or
<br />outfall, licenses, restrictions, and obligations relating to the operation of the Project which, in the
<br />opinion of counsel to the Authority, do not materially impair the use of the Project for the purposes
<br />for which it is designed.
<br />(c) Rights of the United States or any state or political subdivision, thereof, or other
<br />public or governmental authority or agency or any other entity vested with the power of eminent
