RESOLUTION NO. 2020-273R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING A VARIANCE FROM THE CUT AND <br />FILL REQUIREMENTS UNDER SECTION 5.1.1.2 OF THE CITY'S PRIOR <br />LAND DEVELOPMENT CODE TO ALLOW FILL OF UP TO 15 FEET <br />FOR AN APPROXIMATELY 71 ACRE PORTION OF THE WHISPER <br />SUBDIVISION BOUNDED BY YARRINGTON ROAD, FORTUNA ROAD <br />AND OPPORTUNITY BOULEVARD; AND DECLARING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. Section 5.1.1.2 of the prior version of Land Development Code authorizes the City <br />Council to approve a variance to allow cut and fill greater than eight feet. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The City Council hereby grants a variance to allow fill of up to 15 feet <br />within the approximately 71 site for a new warehouse development having frontage along <br />Yarrington Road, Fortuna Road, and Opportunity Blvd within the Whisper Subdivision. <br />PART 2.
