City Council Meeting Minutes December 15, 2020 <br />(3) Propose, if it deems desirable, amendments to this Charter to improve the <br />effective application of said charter to current conditions. <br />(4) Report its finding and present its proposed amendments, if any, to the city <br />council. <br />The city council may take action to amend the charter in the manner provided <br />by state law. The term of office for the commission shall be six months, and, if <br />during such term no report is presented to the city council, then all records of <br />the proceedings of such commission shall be filed with the person performing <br />the duties of the city clerk and shall become a public record. <br />Mr. Cosentino provided history of the last Charter Review Commission that <br />was appointed in 2017. The commission held a series of 12 meetings to <br />consider possible amendments to the San Marcos City Charter. The <br />commission reviewed and discussed amendments suggested by City Council, <br />City Staff, but also conducted a section -by -section review of the charter. <br />Mr. Cosentino stated the appointments to the commission will be made in <br />January 2021. Each council member will appoint one member of the <br />commission who will elect their chair. <br />Council Member Baker provided information that he would like to have <br />considered during the charter commission review: <br />1. Limiting Eminent Domain only for uses of Flood mitigation, or other true <br />public goods instead of allowing it for "Economic development" <br />2. Adding ranked voting to our local elections <br />3. Addressing the salaries of the City Manager, Attorney, and Clerk <br />4. Prohibit more than 1 real estate/developer from serving on Planning and <br />Zoning <br />5. That all official City Documents be translated into Spanish <br />Council Member Derrick is also interested in ranked voting, pursuing the <br />eminent domain possibility with the legislature, would like to review the <br />residency requirements of the city clerk position. <br />Mayor Hughson asked that council consider their nominations carefully <br />because they will need the time to spend on Charter work, and it is very <br />detailed. Mayor Hughson noted that those appointed must have the time <br />available to meet and work on this project and should be detail oriented. <br />Mr. Cosentino reminded council those appointed must live within the city <br />City of San Marcos Page 2 <br />
