ORDINANCE NO. 2020-87 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 39 OF THE SAN MARCOS <br />CITY CODE REGARDING FLOOD DAMAGE PREVENTION BY <br />PROVIDING FOR ENHANCED FLOOD DAMAGE PREVENTION AND <br />MITIGATION STANDARDS; PROVIDING A SAVINGS CLAUSE; <br />PROVIDING FOR THE REPEAL OF ANY CONFLICTING PROVISIONS; <br />AND PROVIDING AN EFFECTIVE DATE. <br />RECITALS: <br />1. City staff proposed amendments to Chapter 39, Flood Damage Prevention, of the <br />San Marcos City Code to provide for enhanced flood prevention and mitigation standards. <br />2. The City Council hereby finds and determines that the adoption of the following <br />ordinance incorporating such amendments is in the interest of the public health, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Chapter 39, Flood Damage Prevention, of the San Marcos City Code is <br />hereby amended as follows (Added text is indicated by underlining. Deleted text is indicated by <br />strikethroughs.): <br />ARTICLE 1. - IN GENERAL <br />Secs. 39.001-39.010. Reserved. <br />ARTICLE 2. FLOOD PROTECTION <br />DIVISION 1. - GENERALLY <br />Sec. 39.011. Statutory authorization. <br />The legislature of the State of Texas has in V.T.C.A., Water Code § 16.315, et seq., <br />delegated the responsibility to local governmental units to adopt regulations designed to <br />minimize flood losses. <br />(1) Authority. The regulations in this article are authorized under the City's Charter, <br />and V.T.C.A., Water Code § 16.315 and § 26.177. <br />(2) Applicability. This article applies to all areas of special flood hazard within the <br />corporate limits of the city. For land inside the city limits, the areas of special <br />flood hazard shall be those identified in the latest flood insurance study or letter <br />of map revision (LOMR) issued to the city by the Federal Emergency <br />
