ARTICLE 1 <br />PURPOSE <br />The purpose of this Interlocal Agreement is to provide a memorandum of the Parties <br />understanding and of their intentions, to continue collaborating in the accommodation of traffic <br />impacts on the Airport created by the proposed Gary Job Corps entrance. Accommodation of <br />these factors could include the establishment of a new "South Entrance", accessed via FM 110, <br />once construction of that roadway is substantially complete. <br />ARTICLE 2 <br />OBLIGATIONS AND RIGHTS OF THE CITY <br />2.1 The City agrees to, in good faith, collaborate with DOL regarding the location of its Gary <br />Job Corps entrance, approximately in the area of the entrance depicted in Exhibit "A", which is <br />incorporated herein for all purposes. <br />2.2 The City agrees that it will collaborate with DOL and the County to fund and establish a <br />"South Entrance" that will access the Airport from FM I10 and will reduce traffic impacts on <br />Airport Drive (the existing primary Airport roadway). <br />ARTICLE 3 <br />OBLIGATIONS OF THE COUNTY <br />3.1 The County agrees to design and have TXDOT construct an extended driveway apron for <br />the "South Entrance" to the Airport. <br />3.2 The County agrees to collaborate with DOL and the City to construct DOL's new <br />entrance, parking lot, guard gate, and guard house ("the Entrance Improvements"), with a goal to <br />time the completion and opening of the Entrance Improvements with the "South Entrance", or its <br />equivalent traffic solution at the Airport. <br />3.3 The County agrees to collaborate with the City to identify and/or obtain funding solutions <br />for roadway improvements on the Airport property, including potential funding from DOL, the <br />City, the County, or other sources. <br />ARTICLE 4 <br />TERM AND TIME OF PERFORMANCE <br />4.1 The effective date of this MOU shall be the date last executed by the Parties, below (the <br />"Effective Date"). The term of the MOU shall continue from the Effective Date until September <br />30, 2023, or until the Parties have fulfilled all obligations under this MOU. <br />ARTICLE 5 <br />NOTICE <br />5.1 Except as may be otherwise specifically provided in this MOU, all notices, demands, <br />ILA/MOU - SM Regional Airport Page 2 <br />
