City Council <br />Meeting Minutes February 2, 2021 <br />10. Consider denial of an Out of City Utility Extension request for water and wastewater <br />services by Thomas K. Rhodes, on behalf of Top of the Hill Properties, LLC for <br />approximately 4.851 acres, more or less, out of the J.M. Veramendi Survey, located at <br />128 Spring Road (previously approved on December 15, 2020), and provide direction to <br />Staff. <br />A motion was made by Deputy Mayor Pro Tem Scott, seconded by Mayor Pro <br />Tem Derrick, to approve the denial of an Out of City Utility Extension request <br />for water and wastewater services located at 128 Spring Road. <br />Shannon Mattingly, Director of Planning and Development Services reviewed <br />the history of the zoning request which was recommended for denial by the <br />Planning and Zoning Commission on August 28, 2018. The applicant <br />withdrew their request and did not request that it be forwarded to city council. <br />The applicant then submitted an application for an ETJ development. They <br />also applied for out -of -city utilities. A presentation was provided regarding the <br />Spring Ranch Villas which is proposed to be 29 residential buildings with 4 to 5 <br />bedroom units each. <br />Mayor Hughson asked about the street width of 20ft pavement with 4ft <br />shoulders and if they will be required to build the full street or just half. Ms. <br />Mattingly stated that they will be required to build and dedicate their half of <br />the street. Assistant Director of Engineering Richard Reynosa stated that they <br />will be required to widen to the 20' road and 4' shoulder on their side of the <br />roadway. <br />Mr. Reynosa noted that the parcel is in the Edwards Aquifer Recharge and <br />Contributing Zones. He provided the environmental considerations impervious <br />cover of 60% max with only 45% proposed on the application. He also noted <br />the requirement for water quality included 87.5% TSS removal and the <br />applicant proposes a wet pond to achieve this. <br />Director of Public Services, Mr. Tom Taggart stated the utility alternatives to <br />connect to city services for water and wastewater. The wastewater service would <br />be to have a on site sewage facility or discharge permit. The water service is to <br />drill a well or connection to other service provider to CCM. <br />Mayor Hughson asked Mr. Taggart to elaborate on what permits would be <br />required to provide utilities to this parcel of land which is in the city's water <br />and wastewater CCNs. Their options for wastewater are to create their own <br />on-site sewage facility which would require a permit from Hays County or <br />apply to obtain a Texas pollution discharge permit from the Texas <br />City of San Marcos Page 17 <br />
