City Council <br />Meeting Minutes February 2, 2021 <br />Council Member Gonzales enforce to complaint driven and thanked Ms. Reyes <br />for the added information. <br />Council Member Garza would like for staff to monitor and bring back to <br />council an update. <br />Mayor Hughson asked to have more education and not have an emergency <br />order. <br />17. Hold a discussion regarding amendments to Sec. 14.372 (a) sentence (2) to remove the <br />words "and occupied" AND "as his homestead", and provide direction to Staff. <br />Council Member Gonzales abstained from discussion on this item to avoid the <br />appearance of impropriety as he owns rental properties. <br />Deputy Mayor Pro Tem Scott requested a discussion on some proposed <br />changes he is requesting an amendment to Sec. 14.372 License required (a) <br />(2). He stated currently the ordinance states that it is unlawful for any person <br />to perform construction work subject to this article unless the person is <br />licensed as a contractor or is exempt under one of the following: (2) A property <br />owner may perform construction work with the owner's own hands or use <br />other persons to perform construction work in/on an existing residence owned <br />and occupied by the owner as his homestead. Such other persons performing <br />work for the property owner shall, however, be subject to applicable licensing <br />requirements under state law. All work is subject to permit, inspection and <br />approval in accordance with this chapter. <br />Mr. Scott would like to remove the words "and occupied" AND "as his <br />homestead" from Section. 14.372 (a)(2). He indicated that people must still <br />follow all safety regulations and permitting from the City, the Building and <br />Occupational Code will be followed and there are certain exceptions per state <br />law such as HVAC, electrical, and plumbing work. <br />His concern is that there are reasons, during Covid, that this can be helpful to <br />our residents. <br />Council Member Gleason supports this amendment and provided an example <br />of how this was important during the floods, where neighbors helped <br />neighbors. <br />Council Member Garza noted her support also. <br />City of San Marcos Page 23 <br />
