<br />The Grantor, for the consideration, has granted, sold and conveyed, and by these presents does grant, sell and convey unto
<br />Grantee, the property, to have and to hold the above described premises, together with all and singular [lie rights and
<br />appurtenances thereto in anywise belonging, unto the Grantee, Grantee's heirs and assigns forever.
<br />As a part of the consideration of Ilse property hereby conveyed, it is agreed and understood that the property shall be subject.
<br />always, to the restrictions imposed by the Governing body of said City of San Marcos in exercising Perpetual Care of the
<br />property. This provision is a covenant running with Ilse land, binding upon the properly, and the present and successive
<br />owners thereof, and inuring to lite benefit of dte Gramor, its successor and assigns, ad to the benefit of the remaining lots in
<br />the cemetery, and the present and successive owner thereof.
<br />Grantor makes this conveyance, and Grantee accepts it, without any warranty as to [lie subsurface condition ofthe property, or
<br />the costs ofmaking intemlents within the property. Grantee, and Grantee's successors and assigns, accept all risks as to such
<br />conditions and costs as a part of this transaction.
<br />This deed is executed on behalf ofGrantor by its Mayor, and attested by its City Clerk, as authorized by an ordinance passed
<br />on August 6, 1924 ofrecord in Vol. 6, a! page 154, in the official minutes of Grantor's City Commission, this the l�i.day of
