CEMETERY DEED <br />Date: September 25, 1998 <br />Grantor: City of San Marcos, a Texas municipal corporation. <br />Grantor's Mailing Address (including county): 630 East Hopkins Street, San Marcos, Hays County, <br />Texas 78666. <br />Grantee: Pablo Canales, Jr. <br />Grantee's Mailing Address (including county): 2030 Pine 98, San Marcos, Hays County, Texas 78666. <br />Consideration: $400.00 <br />Property: Lot Number(s)-!, of Block Number 149 , Section 1 , of the Tower Addition, acquired by <br />the City of San Marcos from the estate of A.M. Ramsay, by deed dated October 15, 1966, recorded in <br />Vol. 216 , pages 626 - 628, of the Hays County Deed records. The plat recorded in Vol. 4 pages 312 <br />& 313. <br />The Grantor, for the consideration, has granted, sold and conveyed, and by these presents does grant, sell <br />and convey unto Grantee, the property, to have and to hold the above described premises, together with <br />all and singular the rights and appurtenances thereto in anywise belonging, unto the Grantee, Grantee's <br />heirs and assigns forever. <br />As a part of the consideration of the property hereby conveyed, it is agreed and understood that the <br />property shall be subject, always, to the restrictions imposed by the Governing body of said City of San <br />Marcos in exercising Perpetual Care of the property. This provision is a covenant running with the land, <br />binding upon the property, and the present and successive owners thereof, and inuring to the benefit of <br />the Grantor, its successors and assigns, and to the benefit of the remaining lots in the cemetery, and the <br />°."present and successive owners thereof. <br />Grantor makes this conveyance, and Grantee accepts it, without any warranty as to the subsurface <br />r condition of the'property, or the costs of making interments within the property. Grantee, and Grantee's <br />d successors and assigns, accept all risks as to such conditions and costs as a part of this transaction_ <br />This deed is executed on behalf of Grantor by its Mayor, and attested by its Secretary, as authorized by <br />an ordinance passed on August 6, 1924 of record in Vol. 6, at page 154, in the official minutes of <br />Grantor's City Commission, this the� day of September , 1998. <br />Attest: <br />anis K.
