<br />The Gnantor, for the conaidoration, has gnantod, sold and onnveyod, and by these presents dumo grant, sell
<br />and convey unto Grantee, the property, to have and to hold the above described premises, together with all and singular
<br />the rights and appurtenances thereto in anywise belonging, unto the Grantee, Grantee's heirs and assigns forever. As
<br />o part of the consideration of the property hereby conveyod, it is agreed and understood that the property shall be
<br />subject, always, to the restrictions imposed by the Governing body of said City of San Marcos in exercising Perpetual
<br />Cam of the property. This provision is a covenant running with the |ond, binding upon the pmperty, and the present
<br />and successive owners thereof, and inuring to the benefit of the Grantor, its successors and assigns, and to the benefit
<br />of the remaining lots in the cemetery, and the present and successive owners thereof.
<br />Grantor makes this conveyance, and Grantee accepts it, without any warranty as to the subsurface condition
<br />ofthe property, orthe costs ofmaking interments within the property. Grantee, and Grantee's successors and assigns,
<br />accept all risks as to such conditions and costs as a part of this transaction.
<br />This deed is executed on behalf ufGrantor by its Mayor, and attested by its City C|erk, as authorized by an
<br />ordinance passed on August 6, 1924 of r rd in V | at page 154, in the offioie| minutes of Grantor's City
