<br />The Bmntor, for the nonaideration, has granted, sold and oonveyed, and by these presents does grant, a*||
<br />and convey unto Grantee, the property, to have and to hold the above described premises, together with all and singular
<br />the rights and appurtenances thereto in anywise belonging, unto the Grantee, Grantee's heirs and assigns forever. As
<br />a port of the consideration of the property hereby cnnveyod, it is agreed and understood that the property ehu|| be
<br />subject, always, to the restrictions imposed by the Governing body of said City of San Marcos in exercising Perpetual
<br />Cane of the property. This provision is a covenant running with the |und, binding upon the property, and the present

<br />of the remaining lots in the cemetery, and the present and successive owners thereof.
<br />Grantor makes this conveyance, and Grantee accepts it, without any warranty as to the subsurface condition
<br />nfthe property, orthe costs ofmaking interments within the property. Grantee, and Grantee's successors and assigns,
<br />accept all risks entosuch conditions and costs anapart ofthis transaction.
<br />This deed is executed on behalf ofGrantor by its Mayor, and attested by its City C|erk, as authorized by an
<br />ordinance passed on August 8 1924 of record in Vol. O. at page 154, in the official minutes of Grantor's City
