CEMETERY DEED <br />CORRECTION <br />Date: <br />Grantor. City of San Marcos, a Texas municipal corporation. <br />Grantors Mailing Address (including county): 630 East Hopkins Street, San Marcos, Hays <br />County, Texas. • <br />Grantees: Phillip Bowden, Tim Bowden, Connie Ray Bowden, Robert W. Bowden, Jr. <br />Grantees' Mailing Address (including county): P.O. Box 8500-502, San Marcos, Hays County, <br />Texas 78666 <br />Consideration: Ten Dollars and other good and valuable consideration <br />Property: Lots 1 through 4 of Block Number 27, Section B-1 and Lot Numbers 1 through 4 of <br />Block Number 11, Section B-1, of the A.M. Ramsay Addition to the San Marcos' City Cemetery <br />Grounds, according to the plat of such addition recorded in Volume 104, Page 479-481, of the Hays <br />County Deed Records. <br />The Grantor, for the consideration, has granted, sold and conveyed, and by these presents <br />does grant, sell and convey unto Grantees, the property, to have and to hold the above described <br />promises, together with all and singular the rights and appurtenances thereto in anywise belonging, <br />unto the Grantees, Grantees' heirs and assigns forever. As a part of the consideration of the <br />property conveyed, it is agreed and understood that the property shall be subject, always, to the <br />restrictions imposed by to Governing body of said City of San Marco; in exercising Perpetual Care <br />of the property. This prevision is a covenant running with the land, binding upon the property, and <br />the present and successive owners thereof, and inuring to the benefit of the Grantor, its successors <br />and assigns, and to the benefit of the remaining lots in the cemetery, and the present and <br />successive owners. <br />Grantor makes this conveyance, and Grantees accept it, without any warranty as to the <br />subsurface condition of the property, or the costs of making interments within the property. <br />Grantees, and Grantees' successors and assigns, accept all risks as to such conditions and costs <br />as a part of this transaction. <br />This deed is made in place of and to correct an unrecorded deed from Grantor to Grantees, <br />dated September 30, 1980. By mistake, that deed inadvertently conveyed to Grantees Lots 1 <br />through 8, Block 41, Section B-3 of the A.M. Ramsay Addition. These lots had already been <br />- conveyed. This correction deed is made by Grantor and accepted by Grantees to correct that <br />mistake, and is effective as of September 30, 1980, and in all other respects confirms the former <br />deed. <br />This deed is executed on behalf of Grantor by its Mayor, and attested by its Secretary, as <br />authorized by an ordinance passed on August 6, 1924o record in Volume 6, at page 154, in the <br />official minutes of Grantors City Commission, this the day of November, 1997. <br />CITY OFSAN MARCOS <br />Attest: By: bM (�V� <br />dBilly G.
