<br />Consideration: None
<br />Property: Lot 4, Block 52, Section B3 of the A.M. Ramsay Addition to the San Marcos Cemetery
<br />Grounds, according to the plat of San Marcos' City Cemetery Grounds, according to the plat of
<br />such addition recorded in Volume 87, Page 605-606, of the Hays County Deed Records.
<br />It is expressly agreed that the above described lot in the Section B3 of the A.M.
<br />Ramsay Addition is conveyed to Grantees, in exchange for Lot 1, Block 2, Section L, Old Original
<br />Addition to the Cemetery Grounds which was conveyed to Grantees in a deed that was never
<br />recorded.
<br />The Grantor, for the consideration, has granted, sold and conveyed, and by these present
<br />does grant, sell and convey unto Grantee, the property, to have and to hold the above described
<br />premises, together with all and singular the rights and appurtenances thereto in anywise
<br />b.elonging,—unto-the-Grantee,—Grantee!s-heirs-and-assigns-forever.
<br />As a part of the consideration for the property hereby conveyed, it is agreed and
<br />understood that the property shall be subject, always, to the restrictions promulgated and/or
<br />imposed by the Governing Body of the said City of San Marcos in exercising Perpetual Care
<br />of the said property conveyed. This provision is intended to be, and shall be construed as,
<br />a covenant running with the land, binding upon the property hereby conveyed, and the present
<br />and successive owners thereof, and inuring to the benefit of the City of San Marcos, its
<br />successors and assigns, and inuring to the benefit of the remaining lots and blocks in said
<br />cemetery, and the present and successive owners thereof.
<br />Grantor makes this conveyance, and Grantee accepts it, without any warranty as to the
<br />subsurface condition of the property, or the costs of making intemments within the property.
<br />Grantee, and Grantee's heirs and assigns; accept all risks as to such conditions and costs as
<br />a part of this transaction.
<br />This deed is executed on behalf of Grantor by its Mayor, and attested by its City
<br />Secretary, as authorized by an ordinance of said Municipal Corporation duly passed by its City
<br />Commission on the 6th day of August, 1924 of record in Volume 6, at page 154, in the official
<br />minute of said Municipalorpor tion, and its official seal hereunto affixed, this the
<br />day of , 2000.
<br />TO HAVE AND TO HOLD the above described premises, together with all and singular
<br />the rights and appurtenances thereto in anywise belonging, unto the City of San Marcos, its
<br />successors and assigns forever.
