<br />Property: Lot Nunbers 1&2, Block 64, Section 1 of the T
<br />Addition to the Sar Marcos Cemetery Grounds, according to
<br />pat of such additi n recorded in Volume 216, Pages 626-627 of
<br />Hays County Plat Records.
<br />It is expressl agreed that the above described lots
<br />Section 1 of the Tow r Addition are conveyed to W.E. West, Jr.,
<br />exchange for Lots 78, Block 65, Section 1 of the Tower Addit
<br />to the Cemetery Gr ands which are recorded in Volume _ems, p
<br />319-8, 1130f the Hays C unty Deed Records, and which are conveyed
<br />the City of San Mar os, Hays County, Texas.
<br />The Grantor, or the consideration, has granted, sold
<br />conveyed, and by these present does grant, -sell and convey
<br />Grantee, the prope ty, to have and to hold the above descr
<br />premises, together with all and singular the- rights
<br />appurtenances thereto in anywise belonging, unto the Gran
<br />Grantee's heirs and assigns forever.
<br />As a part f the consideration for the property her
<br />conveyed, it is agre d and understood that the property shall
<br />subject, always, t the restrictions promulgated and/or impo
<br />by the Governing ody of the said City of San Marc6s
<br />exercising Perpetu 1 Care of the said property herein
<br />conveyed. This provision is intended to be, and shall
<br />construed as, a cov nant running with the land, binding upon
<br />property hereby con yed, and the present and successive own
<br />thereof, and inuring to the benefit of the City of San Marcos,
<br />successors and assigns, and inuring to the benefit of
<br />remaining lots and blocks in said cemetery, and the present
<br />successive owners thereof.
<br />Grantor makes this conveyance, and Grantee accepts it, wit
<br />any warranty as to the subsurface condition of the prope
<br />or the costs of making internments within the property. Gran
<br />and Grantee's heirs and assigns, accept all risks as to
<br />conditions and costs as a part of this transaction.
