City Council Meeting Minutes August 3, 2021 <br />1. Application by Crystal Clear Special Utility District and MCLB Land, LLC for TPDES Permit <br />No. WQ0015266002; TCEQ Docket No. 2020 -0411 -MWD; SOAH Docket No. 582-20-4141; <br />2. Application by Regal, LLC for issuance of New TPDES Permit No. WQ0015817001; TCEQ <br />Docket No. 2020 -0973 -MWD; SOAH Docket No. 582-21-0576; and <br />3. Application of HK Real Estate Development, LLC for Proposed Permit for New TPDES <br />Permit No. WQ0015784001; TCEQ Docket No. 2021 -0053 -MWD; SOAH Docket No. 582- <br />21-1893 <br />Mayor Hughson stated Executive Session concluded at 1:41 a.m. <br />Mayor Hughson stated direction was provided to staff during executive <br />session. <br />VI. Question and Answer Session with Press and Public. <br />Lisa Marie Coppoletta, inquired about agenda item #35 related to the Charter <br />Review Final Report. She stated there was language approved during a regular <br />meeting when there was an opportunity for public comment and then <br />overturned in a work session where there was no public input allowed. She <br />asked why there was no public input allowed at the July 6th meeting? Mr. <br />Cosentino stated the agenda was posted in accordance with the Texas Open <br />Meeting Act (TOMA). This includes being posted 72 hours in advance and <br />available by Zoom to the public. Mr. Cosentino stated the public comment <br />provision speaks to when there is consideration of a matter, the vote happened <br />tonight of what goes on the ballot. <br />Ms. Coppoletta asked if council could have changed the language tonight? Mr. <br />Cosentino stated yes, the caption would have allowed the language to be <br />changed. <br />Ms. Coppoletta asked why Work Sessions are not currently covered under <br />TDMA. Mr. Cosentino stated they are covered under TDMA. He stated it is a <br />matter of consideration and there is no final vote on a matter during the Work <br />Session. <br />VII. Adjournment. <br />A motion was made by Mayor Pro Tem Derrick, seconded by Mayor Hughson, <br />to adjourn the regular meeting of the City Council on Wednesday, August 4, <br />City of San Marcos page 27 <br />
