ORDINANCE NO. 2021-56 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF $34,530,000 OF COMBINATION TAX AND REVENUE CERTIFICATES OF OBLIGATION, SERIES 2021A FOR CONSTRUCTING, IMPROVING, DESIGNING, ACQUIRING AND EQUIPPING THE CITY'S (1) WATER AND WASTE WATER SYSTEM; (2) ELECTRIC UTILITY SYSTEM; (3)STREETS INCLUDING RELATED DRAINAGE, SIDEWALKS, TRAFFIC IMPROVEMENTS AND LIGHTING, INCLUDING ACQUISITION OF RIGHT-OF-WAY; (4)MUNICIPAL BUILDINGS TO INCLUDE HVAC IMPROVEMENTS, ROOF REPLACEMENTS AND SECURITY IMPROVEMENTS; (5) STORMWATER MANAGEMENT AND FLOOD CONTROL FACILITIES, INCLUDING ACQUISITION OF LAND; (6) AIRPORT; (7) PUBLIC SAFETY FACILITIES TO INCLUDE POLICE AND FIRE IMPROVEMENTS AND TECHNOLOGY EQUIPMENT UPGRADES; (8) NETWORK AND FIBER OPTIC INFRASTRUCTURE EQUIPMENT; (9) RECREATIONAL FACILITIES INCLUDING PARKS AND SPORTS FIELDS;(10) PARKING FACILITIES; AND (11) THE PAYMENT OF PROFESSIONAL SERVICES IN CONNECTION THEREWITH INCLUDING LEGAL, FISCAL AND ENGINEERING FEES AND THE COSTS OF ISSUING THE CERTIFICATES OF OBLIGATION AND OTHER MATTERS RELATED THERETO WHEREAS, the City Council (the "City Council") of the City of San Marcos, Texas (the "City"), by resolution adopted on June 1, 2021, directed publication of notice of the City's intention to issue interest bearing certificates of obligation in a total aggregate principal amount not to exceed $72,670,000, in one or more series, for the purposes hereinafter set forth; WHEREAS, such notice was published and posted on the internet, each in the manner and to the extent required by law; WHEREAS, there has not been filed with the City Clerk or any other officer of the City a petition protesting the issuance of such certificates of obligation and requesting an election on same; WHEREAS, it is affirmatively found and determined that the City is authorized to proceed with the issuance and sale of such certificates of obligation as authorized by the Constitution and laws of the State of Texas, including, particularly, Tex. Loc. Gov't Code Ann. Ch. 271, subch. C, and Tex. Gov't Code Ch. 1502; and WHEREAS, it is officially found, determined and declared that the meeting at which this Ordinance has been adopted was open to the public and public notice of the date, hour, place and subject of said meeting, including this Ordinance, was given, all as required by the applicable provisions of Tex.
