ORDINANCE NO. 2021-
<br />ORDINANCE AUTHORIZING THE ISSUANCE OF CITY OF SAN MARCOS, TEXAS
<br />GENERAL OBLIGATION BONDS, SERIES 2021 FOR (1) CONSTRUCTING,
<br />IMPROVING, RENOVATING AND EQUIPPING PUBLIC SAFETY FACILITIES TO
<br />INCLUDE THE POLICE AND FIRE DEPARTMENTS AND RELATED EMERGENCY
<br />AND TRAINING FACILITIES AND RELATED WATER,WASTEWATER, DRAINAGE,
<br />STREETS, SIDEWALKS, PARKING, INFRASTRUCTURE AND OTHER RELATED
<br />COSTS, AND (2) PAYING THE LEGAL FEESAND OTHER SUCH COSTS INCURRED
<br />IN CONNECTION THEREWITH; INCLUDING THE COSTS OF ISSUING THE BONDS
<br />AUTHORIZING THE LEVY OF AN AD VALOREM TAX IN SUPPORT OF THE BONDS;
<br />APPROVING AN OFFICIAL STATEMENT, A BOND PURCHASE AGREEMENT, A
<br />PAYING AGENT/REGISTRAR AGREEMENT, AND OTHER DOCUMENTS RELATED
<br />TO THE ISSUANCEOF THE BONDS
<br />THE STATE OF TEXAS '
<br />COUNTIES OF HAYS, CALDWELL AND GUADALUPE '
<br />CITY OF SAN MARCOS '
<br />WHEREAS, at an election held within the City of San Marcos, Texas (the "City") on May
<br />6, 2017 the voters of the City authorized the City Council of the City to issue in one or more series
<br />the bonds set forth in proposition numbers 1 and 2, which aggregate $32,200,000 in aggregate
<br />principal amount; and
<br />WHEREAS, the City Council deems it to be in the best interest of the City to issue an
<br />aggregate amount of $4,750,000 of the remaining $4,750,000 in aggregate principal amount of the
<br />bonds authorized by Proposition Number 1 for the purpose of constructing, improving, renovating
<br />and equipping Public Safety Facilities to include the police and fire departments and related
<br />emergency and training facilities, including improvements to the police station, construction of a
<br />new Fire Station No. 8 and replacing existing Fire Station No. 2 and the acquisition of any necessary
<br />sites and related water, wastewater, drainage, streets, sidewalks, parking, infrastructure and other
<br />related costs and reserves the right to issue the remaining authorized but unissued bonds at such
<br />time as determined by the City Council; and
<br />WHEREAS, following issuance of the Bonds, there will be no voted authorization
<br />remaining from the above referenced Proposition Number 1; and
<br />WHEREAS, the Bonds (hereinafter defined) authorized by this Ordinance are being issued
<br />and delivered pursuant to the City Charter and to Chapters 1251 and 1331, Texas Government
<br />Code, as amended, and other applicable laws; and
<br />WHEREAS, it is hereby officially found and determined that the meeting at which this
<br />Ordinance was passed was open to the public, and public notice of the time, place and purpose of
<br />said meeting was given, all as required by Chapter 551, Texas Government Code.
