If they haven't <br />done so in writing, Mr. Gary requested that requirement be made part <br />of the minutes. Mr. Gary doesn't think interpretation of that stat- <br />ute would meet the requirements of the statute of extending utilities <br />into an area to be annexed. There is also a problem in the sewer line <br />on the West side close to the intersection with Seguin Highway in that <br />those lines do not go into the property to be annexed. Mayor Craddock <br />stated utility lines would not be extended into non-annexed property, <br />and Mr. Gary pointed out that there has to be a plan that meets this <br />statute, and the plan presented to the Council has no extension what- <br />soever into the property. City Manager Gonzalez pointed out Mr. Gary <br />was using the words utilities and services interchangeably and wanted <br />to point out the difference between the extension of services into the <br />property and utilities, because the extension of services includes <br />public safety, fire protection and other services other than utilities <br />which is a different issue than utilities. Mr. Gary stated if the stat- <br />ute is saying services does not include utilities, then he is in error, <br />but he thinks the service plan includes the service of utilities, and <br />Mr. Gary is speaking strictly to utilities. City Manager Gonzalez <br />pointed out there are cities that don't own the utilities of water <br />and sewer, such as the City of San Marcos does not own the light or <br />gas utility, and in that case the utility would have absolutely noth- <br />ing to do with the services that would be extended to an area. That <br />is Mr. Gary's basic objection with the plan. The other factor is the <br />feasiblity from an economic standpoint of the exposure on behalf of <br />the taxpayers, the two exposures basically are if the plan is ade- <br />quate and the exposure of the liability of maintaining the road. <br />This particular plan is also objectionable because it doesn't say <br />what is going to be done to the road or bridge but is vague in that <br />regard and needs to be more specific. Mr. Gary also requested in his <br />letter of February 15, 1982 a determination by the Staff of what portion <br />of the 135 acres to be annexed was owned by the Thorntons. City Manag~ <br />Gonzalez said the information gathered was done by Mr. Garza. Mr. Gar~ <br />stated he has not yet received the acreage owned by each individual but <br />has a map that shows it, J. M. Cape approximately 30.72 acres, J. M. <br />Cape 2.22 acres, J. R. Thornton 33.597 acres, 12.42 acres, B. M. Cape <br />16.5 acres, John Stokes 9.58 acres, John Stokes 6.52 acres, Mrs. Forrest <br />Cape 4.62 acres. Mr. Gary asked if there was a determination of what <br />portion of the Thornton property falls in the floodway. Joe Garza said <br />we have a determination based on the Soil Conservation's data, we have <br />two maps showing the floodway and flood plain of the San Marcos and <br />Blanco Rivers. Mr. Gary asked if it showed what portion of the Thorn- <br />ton's 45 acres, more or less, falls in the floodway. Joe Garza said <br />we do not know at this time. Mr. Gary asked that the maps be made a <br />part of the record showing the floodway and flood plain. Mr. Gary <br />asked if the Staff had estimated the city taxes that would be derived <br />for 1983 from this property. Joe Garza replied that in a memorandum <br />from Charles Stone to Earl Williams a value was determined from data <br />from the San Marcos Consolidated Independent School District file, and <br />this memorandum is attached to these minutes. Mr. Gary pointed out to <br />Mr. Garza the school tax rate was not based on agricultural use, and <br />Mr. Garza said that was correct. Mr. Gary asked if the estimation of <br />taxes of around $3,000.00 is accurate. Mr. Garza replied with an esti- <br />mation made on an original annexation study in December of 1980 on <br />areas D and D Prime, D annual tax revenue to be $1,872.40, D Prime <br />annual tax revenue to be $1,020.00, total $2,892.90. Mr. Gary asked <br />if the estimate or any portion was based on agricultural use. Mr. Garæ <br />said he was not sure. Mr. Gary asked if there were any statements in <br />writing as to the requirements of the City for tapping into a 20-inch <br />force main along River Road. Mr. Garza said nothing was in writing, but <br />Mr. George Boeker was working on this now. City Manager Gonzalez added <br />it would also greatly depend on the type line we would be tapping it <br />with and the amount of affluent that is being put into the line, so <br />there are a lot of design factors that have to be known before a cost <br />estimate could actually be produced, instead of just saying tapping a <br />line. Mr. Gary said the factors involved would vary greatly as to the <br />
