City Council Meeting Minutes December 15, 2021 For: 5 - Mayor Hughson, Council Member Gonzales, Mayor Pro Tem Scott, Council Member Gleason and Council Member Prather Against: 2 - Council Member Baker and Deputy Mayor Pro Tem Garza 12. Consider approval of Resolution 2020-258R, authorizing a Change in Service to the agreement with the San Marcos Area Chamber of Commerce to extend the agreement for one year in the amount of $28,760 and authorizing two additional annual renewals; authorizing the City Manager or his designee to execute the agreement on behalf of the City; and declaring an effective date. A motion was made by Mayor Pro Tem Scott, seconded by Council Member Gleason, to approve Resolution 2021-258R. Council Member Baker expressed concern that the City charges $1.00 for the land and Chamber of Commerce is charging us a large amount for office rental. Mayor Hughson stated the Chamber of Commerce pays for the building and we pay for the office space and other services. The motion carried by the following vote: For: 5 - Mayor Hughson, Council Member Gonzales, Mayor Pro Tem Scott, Council Member Gleason and Council Member Prather Against: 2 - Council Member Baker and Deputy Mayor Pro Tem Garza NON -CONSENT AGENDA 18. Consider approval of Ordinance 2021-97, authorizing the Issuance of the "City Of San Marcos, Texas Special Assessment Revenue Bonds, Series 2022 (Whisper South Public Improvement District Project)"; Approving and Authorizing an Indenture of Trust, a Bond Purchase Agreement, an Offering Memorandum, a Continuing Disclosure Agreement, a Landowner Agreement, an Agreement Regarding Waiver of Right of Redemption and Waiver of Agricultural Valuation, Financing Agreement, Construction, Funding and Acquisition Agreement and Other Agreements and Documents in Connection Therewith; Making Findings with Respect to the Issuance of Such Bonds; and Providing for approval of this Ordinance on only one reading as authorized by State Law; and providing an Effective Date. A motion was made by Mayor Pro Tem Scott, seconded by Mayor Hughson, to approve Ordinance 2021-97, on only one reading as authorized by State Law. Bart Fowler, bond counsel, provided a brief presentation on the issuance bonds for Whisper South PID. Dan Wegmiller, bond counsel, provided a the presentation on the bond sale and interest rate. Mayor Hughson asked if the taxpayers will be paying money on this project. Mr. Wegmiller stated they are not and it falls on the property owners paying City of San Marcos Page 12
