City Council <br />Meeting Minutes February 1, 2022 <br />agreement on behalf of the City; and providing an effective date; and consider approval of <br />Resolution 2022-32R. <br />Amanda Hernandez, Assistant Director of Planning and Development Services, <br />provided a presentation regarding the Whisper East Development Agreement <br />for approximately 153.09 acres located South of the intersection Yarrington <br />Road and Harris Hill Rd. The Whisper East development agreement is <br />intended to mirror the development patterns previously approved in the <br />Whisper North PDD and Whisper South Development Agreement. This <br />includes the modification / waiver of Development Code standards such as: <br />parking lot location and build -to zones, alley requirements, and the allowance <br />for double fronting lots She stated the developer is proposing dedication of <br />parkland which will be publicly accessible, but privately owned and <br />maintained. A three -acre fire station site will be donated as part of this <br />agreement. <br />Mayor Hughson opened the Public Hearing at 9:04p.m. <br />There being no speakers, Mayor Hughson closed the Public Hearing at <br />9:05p.m. <br />A motion was made by Mayor Pro Tem Scott, seconded by Council Member <br />Prather, to approve Resolution 2022-32R. The motion carried by the following <br />vote: <br />For: 6 - Mayor Hughson, Council Member Gonzales, Mayor Pro Tem Scott, Deputy Mayor <br />Pro Tem Garza, Council Member Prather and Council Member Gleason <br />Against: 1 - Council Member Baker <br />16. Receive a Staff presentation and hold a Public Hearing to receive comments for or against <br />Resolution 2022-33R, providing no objection to the submission of an application for low income <br />housing tax credits to the Texas Department of Housing and Community Affairs for the <br />proposed LIV at Whisper Hills (55+) Multifamily Housing Project (LIHTC-21-02) located in the <br />500 Block of Celebration Way; approving findings related to the application; imposing <br />conditions for such non objection; approving an associated agreement under which the owner <br />of the project will make an annual payment in lieu of taxes in the amount of $11,000 annually; <br />providing authorization for the execution of said agreement and the execution and submission <br />of documents related to the application; and declaring an effective date; and consider approval <br />of Resolution 2022-33R. <br />Shannon Mattingly, Director of Planning and Development Services, provided <br />a presentation regarding LIV at Whisper Hills (55+) Multifamily Housing <br />Project located in the 500 Block of Celebration Way within the Whisper <br />Planned Development District (PDD). The applicant is proposing a 267 unit <br />senior (55+) multifamily project. There will be 27 units for those at 0-30%AMI, <br />38 units for those at 31-50% AMI, 176 units for those at 51-60% AMI, 26 units <br />City of San Marcos Page 16 <br />
