EXHIBIT C <br />Form of Consent Ordinance <br />ORDINANCE NO. <br />AN ORDINANCE GRANTING THE CONSENT OF THE CITY OF SAN <br />MARCOS, TEXAS, TO THE CREATION OF HAYS COUNTY MUNICIPAL <br />UTILITY DISTRICT NO. 8 WITHIN THE CITY'S EXTRATERRITORIAL <br />JURISDICTION <br />WHEREAS, the City of San Marcos, Texas (the "City") received a Petition for Consent to <br />the Creation of a Municipal Utility District and inclusion of 567.663 acres of land, more or less, <br />located in the City's extraterritorial jurisdiction, as more particularly described in Exhibit A <br />attached hereto (the "Land"); and <br />WHEREAS, Section 54.016 of the Texas Water Code and Section 42.042 of the Texas <br />Local Government Code provide that land within a municipality's extraterritorial jurisdiction may <br />not be included within a municipal utility district without the municipality's written consent; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS: <br />That the City Council of the City of San Marcos, Texas, gives its written consent to the <br />creation of Hays County Municipal Utility District No. 8 (the "District") and the inclusion of the <br />Land therein. <br />That the District is authorized to exercise all powers granted to a municipal utility <br />district, or which may be hereafter granted, under the Constitution and laws of the State of <br />Texas. <br />PASSED AND APPROVED on the day of 12022. <br />ATTEST: <br />City Secretary <br />960913_4 <br />Mayor <br />
