RESOLUTION NO. 2022-134R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING A SOLE SOURCE CONTRACT WITH <br />ENVIRONMENTAL SYSTEMS RESEARCH INSTITUTE, INC. (ESRI) <br />FOR A THREE-YEAR CONTRACT RENEWAL FOR GEOGRAPHIC <br />INFORMATION SYSTEM SOFTWARE SUBSCRIPTIONS AND <br />MAINTENANCE SERVICES IN AN AMOUNT NOT TO EXCEED <br />$196,053.00 OVER A THREE-YEAR TERM; AUTHORIZING THE CITY <br />MANAGER OR HER DESIGNEE TO EXECUTE THIS CONTRACT ON <br />BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br />WHEREAS, Section' 252.022 (7) of the Texas Local Government Code permits a limited <br />exemption from the competitive sealed proposal procedure if the items to be purchased are <br />available from only one source; and <br />WHEREAS, this purchase is a sole source procurement because Environmental Systems Research <br />Institute, Inc. (ESRI) is the exclusive source of the product and is the sole source of license <br />renewals and extensions of products for products already in use by the City because of patents and <br />copyrights; NOW THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. A sole source contract with Environmental Systems Research Institute, Inc. <br />(ESRI) for a three-year contract renewal for Geographic Information System Software <br />Subscriptions and Maintenance Services in an amount not to exceed $196,053.00 over a three-year <br />term is hereby approved. <br />PART 2. The City Manager, or her designee, is authorized to execute said contract <br />on behalf of the City. <br />PART 3.
