C. At least three days before the closing date for the purchase of the Property, <br />provide the County with the name and contact information for the title company and <br />closing agent processing the closing of the purchase of the Property and a copy of the final <br />draft of the HUD -1 settlement statement to enable the County to issue a check or wire <br />transfer funds drawn from Bond Funds in the amount of $6,600,000.00 to the title company <br />to be applied toward the purchase price of the Property. <br />d. Together with the HUD -1 settlement statement, provide a draft copy of the <br />proposed deed conveying title to the Property to the City that includes a restriction running <br />with the land providing that the Property shall be dedicated and used by the City as public <br />parkland with the right of access by the public in accordance with the City's adopted park <br />rules and regulations. Closing of the purchase of the Property shall not occur until the <br />County's general counsel has approved the form of deed in writing to the City and the title <br />company. <br />e. Within five days after closing on the purchase of the Property, deliver to the <br />County copies of the recorded deed conveying the Property to the City, together with all <br />closing documents, including the HUD -1 settlement statement. <br />IV. County's Rights and Duties. <br />In consideration of the City restricting the Property for use as parkland and contributing <br />the Matching Funds, the County shall: <br />a. Within three days after receipt of the draft form of deed for the purchase of <br />the Property, provide the written approval of the proposed form of deed to the City and the <br />title company, or provide any proposed modifications to the City for the City's <br />concurrence. <br />
