2022-2025 Meet and Confer Agreement <br />Between the San Marcos Police Officers' Association and the City of San Marcos, Texas <br />ARTICLE 8 <br />COMPENSATORY TIME <br />As permitted by the Fair Labor Standards Act ("FLSA"), 29 U.S.C. § 207(o), the City may compensate eligible <br />nonexempt Officers with compensatory time in lieu of overtime compensation required by the FLSA, 29 <br />U.S.C. § 207 or Article 7. Such compensatory time will be at a rate of not less than one and one- half hour <br />for each hour of employment for which overtime compensation is required by 29 U.S.C. § 207 or Article <br />7. Only officers on regular assignments as School Resource Officers (SRO's) are eligible to accrue <br />compensatory time. SRO's may not accrue more than 160 hours of compensatory time and time must be <br />used or paid out no later than one year afterthe start of the school year. <br />This Article supersedes any and all contrary agreements or understandings related to compensatory time <br />arrived at between the City and any individual member of the, bargaining unit during the term of this <br />Agreement. If this Agreement expires, any lawful contracts or understandings that were made with <br />individual Officers regarding compensatory time, including that contained in existing policy, will apply. <br />If there is a conflict between this agreement and the Department of Labor requirements, the Department <br />of Labor requirement shall govern. <br />This Article preempts any conflicting state statutes (including Texas Local Government Code Chapters 141, <br />142, and 143), local ordinances, executive orders, civil service provisions, or rules adopted by the Chief of <br />Police or City or by any division or agent of the City, including any City personnel board and the Firefighters <br />and Police Officers Civil Service Commission, as provided by Texas Local Government Code Section 142.067. <br />PAGE 15 <br />
