RESOLUTION NO. 2022-148R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING A RESTATED AND AMENDED INTERLOCAL COOPERATION AGREEMENT WITH TEXAS STATE UNIVERSITY RELATING TO THE EDWARDS AQUIFER HABITAT CONSERVATION PLAN TO, AMONG OTHER THINGS, PROVIDE THE PROCESS FOR THE EQUAL SHARING IN THE COST OF THE SALARY FOR THE HABITAT CONSERVATION PROJECT PLAN MANAGER, IDENTIFY CONSERVATION PLAN SERVICES TO BE PROVIDED BY TEXAS STATE UNIVERSITY AT A COST OF UP TO $266,000.00 PER YEAR AND NOT TO EXCEED $2,830,316.56 DURING THE TERM, AND EXTEND THE TERM OF THE AGREEMENT THROUGH MARCH 31, 2028; AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE, TO EXECUTE THIS AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The attached Restated and Amended Interlocal Cooperation Agreement with Texas State University relating to the Edwards Aquifer Habitat Conservation Plan to, among other things, provide the process for the equal sharing in the cost of the salary for the Habitat Conservation Project Plan Manager, identify conservation plan services to be provided by Texas State University at a cost of up to $266,000.00 per year and not to exceed $2,830,316.56 during the term, and extend the term of the Agreement through March 31, 2028, (Contract No. 2170077- 1) is approved. PART 2. The City Manager, or her designee, is authorized to execute said agreement on behalf of the City. PART 3. Upon its execution by both parties, said agreement will supersede the agreement approved by Resolution No. 2021-163R. PART 4.
