49.215, of the Texas Water Code is applicable; <br /> b. The property commonly referred to as the"Hillert Tract"containing 563.199 acres,which <br /> includes and contains the"R.BR Tract" and the"Lennar Tracts", as depicted in Tract Map <br /> attached as Exhibit "A" (the Hillert Tract, inclusive of the RBR Tract, and the Lennar <br /> Tracts, being referred to collectively herein as "Said Tracts"), is located within the <br /> corporate limits of the City, and Said Tracts were incorporated within the City by the <br /> passage of Ordinance 2008-016, adopted on April 19, 2008; <br /> c. The district boundaries of the CCSUD, as established by Chapter 7206 of the Texas <br /> Special District Local Laws Code, and as they exist on the date of adoption of this <br /> Resolution,do not include Said Tracts,and Said Tracts are not located within the district <br /> boundaries of the CCSUD, which are accurately depicted on the Tract Map attached <br /> hereto as Exhibit"A"; and <br /> d. The City has never given its consent, by ordinance or resolution, for CCSUD to provide <br /> potable water service or to install facilities to provide potable water service to Said Tracts <br /> which are located within the City's corporate limits. <br /> SECTION 2. If any word,phrase,clause, sentence, or paragraph of this resolution is held <br /> to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br /> resolution will continue in force if they can be given effect without the invalid portion. <br /> SECTION 3. All resolutions or parts of resolutions in conflict with this resolution are <br /> repealed. <br /> SECTION 4. The meeting at which this resolution was considered was an open meeting, <br /> and the notice of the meeting and that possible action on this resolution would take place therein, <br /> was posted in accordance with the requirements of Chapter 551 of the Texas Government Code. <br /> SECTION 5.
