ORDINANCE NO.2022-91 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS,TEXAS APPROVING THE ABANDONMENT OF AN ALLEY IN BLOCK 3 OF THE DAN MCKIE SECOND ADDITION THAT RUNS THE LENGTH OF THE BLOCK BETWEEN EAST GROVE AND LEE STREETS, AND AUTHORIZING THE CONVEYANCE OF THE ALLEY,TOGETHER WITH LOTS 1, 2, 6 AND 7 OF SAID BLOCK TO THE SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL DISTRICT;AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE, TO EXECUTE THE APPROPRIATE CONVEYANCE INSTRUMENTS AS TO SAID ALLEY AND LOTS, SUBJECT TO APPROVAL OF THE FORMS THEREOF BY THE CITY ATTORNEY; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The following real property interests out of Block 3, Dan McKie Second Addition,an addition to the City of San Marcos,Hays County,Texas,according to the map or plat thereof recorded in Volume 29, Page 115, Plat Records of Hays County, Texas, are hereby authorized to be abandoned and conveyed to the San Marcos Consolidated Independent School District: a. The alley running north and south between East Grove and Lee Streets,to be conveyed by quitclaim deed; b. Lots 1 and 2, to be conveyed by special warranty deed; and C. Lots 6 and 7, to be conveyed by quitclaim deed. Each of the foregoing real property interests are illustrated in Exhibit A,attached hereto and made a part hereof for all purposes. SECTION 2. The City Manager, or her designee, is authorized to execute appropriate instruments conveying said real property interests to the San Marcos Consolidated Independent School District, subject to the City Attorney's approval of the forms thereof. SECTION 3. If any word,phrase,clause,sentence,or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4: All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. This Ordinance will take effect immediately after the date of its final passage.
