Box 1087 <br /> San Marcos, Texas 78667 <br /> City of San Marcos <br /> Bei:t r., br Stephanie Reyes, Interim City Manager <br /> 630 East Hopkins <br /> San Marcos, TX 78666 <br /> 15.3 Agreement, This Agreement represents the complete School Resource Officer Program <br /> Agreement between the DEPARTMENT and the SMCISD. <br /> 15.4 Amendment. No amendment, modification, or alteration of the terms of this Agreement shall <br /> be binding unless it is in writing with dates of amendments sequent to the date of this Agreement, <br /> and duly executed by the parties to this Agreement. <br /> 15.5 No Waiver of Immunity. Neither SMCISD or DEPARTMENT waives or relinquishes any <br /> immunity or defense on behalf of itself, its trustees, officers, employees and agents as a result of <br /> its execution of this Agreement and performance of the covenants contained herein. SMCISD and <br /> the DEPARTMENT acknowledge that SMCISD and the DEPARTMENT are both political <br /> subdivisions of the State of Texas and no provision of this Agreement shall be deemed to waive, <br /> modify, or amend any sovereign or governmental immunity available to either party and/or its <br /> elected officials,officers,employees and agents under federal or Texas law nor waive any defenses <br /> or remedies available at law to either party and/or its elected officials, officers, employees, and <br /> agents under Federal or Texas law. <br /> 15.6 Texas Law to Apply.
