Lessor's acceptance of insurance certificates that do not comply with these requirements will not
<br />release the Lessee from compliance with these provisions.
<br />11.03. It is further agreed that Lessee shall not do or permit to be done anything upon any portion of the
<br />Leased Premises or bring or keep anything thereon which will in any way conflict with the
<br />conditions of any insurance policy upon the Leased Premises, or in any way increase the rate of
<br />insurance upon the Leased Premises, or which will in any way obstruct or interfere with the rights
<br />of other tenants at the Airport.
<br />11.04. Casualty Coverage: During the full tenn of this Lease, Lessee shall, at its sole cost and expense,
<br />cause all improvements on the Leased Premises to be kept insured to the full insurable value thereof
<br />against the perils of explosion, fire, extended coverage, and like perils. "Improvements" shall
<br />include but not be limited to all buildings and other structures on the premises. In the event any
<br />improvement on the Leased Premises, or any part thereof, shall at any time during the term of this
<br />Lease be damaged or destroyed by fire or other casualty so as to render the same unfit for use and
<br />occupancy, Lessee may either repair or rebuild the damaged improvement, or may elect not to
<br />repair or rebuild. If Lessee elects not to repair or rebuild, then this Lease shall continue in force
<br />for the remainder of the lease term, and the insurance policy will provide that the Lessor will be
<br />paid all funds to which Lessee is entitled as proceeds under the policy. If Lessee elects to repair
<br />or rebuild, such repair or rebuilding shall be at Lessee's cost and expense, which amount shall
<br />include the proceeds of the insurance policy required hereunder, and this Lease shall continue.
<br />11.05. Indemnity and Hold Harmless
<br />a. LESSEE AGREES TO HOLD HARMLESS, INDEMNIFY, AND DEFEND THE
<br />LESSOR AND AIRPORT MANAGER AND THEIR OFFICERS, AGENTS, OWNERS,
<br />AND EMPLOYEES FROM AND AGAINST ALL CLAIMS, SUITS, AND ACTIONS
<br />BY THIRD PARTIES FOR LOSS OF LIFE, PERSONAL INJURY, OR PROPERTY
<br />DAMAGE ARISING IN CONNECTION WITH THE USE OF LESSEE'S PREMISES
<br />OR ANY AREAS OF THE AIRPORT BY LESSEE, ITS AGENTS, CONTRACTORS,
<br />EMPLOYEES, SERVANTS, INVITEES, OR LICENSEES.
<br />b. LESSEE SHALL USE THE AIRPORT AND USE, OCCUPY, AND STORE
<br />PROPERTY ON ITS PREMISES AND ON ANY AREAS OF THE AIRPORT AT ITS
<br />OWN RISK, AND LESSEE AGREES TO HOLD HARMLESS AND RELEASE
<br />LESSOR AND AIRPORT MANAGER AND THEIR OFFICERS, AGENTS, OWNERS,
<br />AND EMPLOYEES FROM ALL CLAIMS, SUITS, AND ACTIONS BY LESSEE OR
<br />ITS OFFICERS, AGENTS, OWNERS, EMPLOYEES, SERVANTS, INVITEES, OR
<br />LICENSEES FOR LOSS OF LIFE, PERSONAL INJURY, OR PROPERTY DAMAGE
<br />OCCURRING ON LESSEE'S PREMISES OR ON ANY AREAS OF THE AIRPORT,
<br />INCLUDING THOSE RESULTING FROM THE SOLE NEGLIGENCE OR OTHER
<br />ACTIONABLE CONDUCT OF THE LESSOR OR AIRPORT MANAGER, THEIR
<br />OFFICERS, AGENTS, OWNERS, OR EMPLOYEES, OR FROM ACTS OR
<br />OMISSIONS OF THIRD PERSONS.
