RESOLUTION NO. 2022 -213R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING AN EXPENDITURE OF $120,385 FROM THE PERMANENT ART FUND FOR THE PURCHASE OF FOUR SCULPTURES AS RECOMMENDED BY THE ARTS COMMISSION; AUTHORIZING THE CITY MANAGER TO EXECUTE RELATED DOCUMENTS, INCLUDING A CONTRACT WITH DIMENSION GALLERY IN THE ESTIMATED AMOUNT OF $94,135; AND DECLARING AN EFFECTIVE DATE. WHEREAS, Section 252.022 (7) of the Texas Local Government Code permits a limited exemption from the competitive sealed proposal procedure if the items to be purchased are available from only one source; and WHEREAS, the City Council finds this purchase is a sole source procurement (with personal services) because the artists and galleries selected are the exclusive source of the individual artwork items selected and are the sole source of copyrights for these products; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. An expenditure of$120,385 from the Permanent Art Fund for the purchase of four sculptures as recommended by the San Marcos Arts Commission is approved. PART 2. The City Manager or her designee is authorized to execute related documents, including a contract with Dimension Gallery in the estimated amount of$94,135.00. Contracts with artists from the remaining funds authorized in this Resolution are authorized to be executed in accordance with the City's purchasing policies governing purchases from artists. PART 3.
