<br />Grantee: Alliance Regional Water Authority, a conservation and reclamation district created by
<br />the Texas Legislature under Article XVI, Section 59 of the Texas Constitution
<br />Grantee's Address: 630 East Hopkins Street, San Marcos, Hays County, TX 78666
<br />Consideration: Ten Dollars ($10.00) and other good and valuable consideration, the receipt and
<br />sufficiency of which is hereby acknowledged.
<br />Easement Property: A tract of land consisting of acres more or less, as described in the
<br />attached Exhibit A, which is incorporated in and made a part of this instrument for all purposes.
<br />Utility Facilities: Water lines, transmission mains, service lines and connections, pumps, drain
<br />valve assemblies, air releases, valves, and related electrical and communication poles, lines,
<br />facilities, equipment and appurtenances, route markers, access ways and all other above -ground and
<br />below -ground appurtenances deemed by the Grantee to be necessary or desirable with respect to
<br />the Utility Facilities.
<br />Grant of Easement. Grantor, for the Consideration, grants, sells, and conveys to Grantee, its
<br />successors and assigns, a perpetual, non-exclusive utility and right-of-way easement upon, within,
<br />over, under and across the Easement Property, together with all and singular the rights and
<br />appurtenances thereto in anywise belonging. The purposes for this easement include 1) to excavate
<br />for, place, lay, construct, install, operate, maintain, replace, relocate, upgrade, remove and repair the
<br />Utility Facilities, and all activities necessary and incidental to constructing, operating and maintaining
<br />the Utility Facilities and 2) ingress and egress at all times upon and across the Easement Property,
<br />and the construction, operation, maintenance, replacement, repair, upgrade and removal of one or
<br />more access ways and related drainage improvements, facilities and equipment, and all activities
<br />necessary and incidental to constructing, operating and maintaining access ways and related drainage
<br />improvements.
<br />Mineral Rights. All oil, gas and other mineral rights remain with Grantor, including but not
<br />limited to gas strata, uranium and other fissionable materials in, on and under the Easement
<br />Property; provided, however, Grantor shall not be permitted to drill or operate equipment for the
<br />production of minerals on the Easement Property, but they will be permitted to extract the oil, gas,
