(4) San Marcos Reinvestment Corporation and San Marcos Habitat for Humanity when building new <br />affordable single-family residential dwellings; <br />(5) The Housing Authority of the City of San Marcos, for construction projects on property owned by it, for <br />low-income housing or administrative offices; and <br />(6) Any taxing unit as defined under Section 1.04(12) of the Texas Tax Code for construction projects <br />having a permitted value of $3,000.00 or less. <br />(c) Residential home improvement exemption. A person making repairs or improvements to a residential <br />dwelling requiring the issuance of a permit by the City is exempt from the payment of all applicable fees <br />imposed under this chapter if: <br />(1) Such person owns and occupies the residential dwelling; <br />(2) The residential dwelling is designated as such person's homestead by the county appraisal district <br />having jurisdiction; and <br />( Ord. Building accessibility. <br />(a) Before a contractor applies for a permit for a building or structure subject to section 5(j) of the State <br />Architectural Barriers Act, the contractor shall provide proof that he has registered the construction <br />documents with the state department of licensing and regulation. Proof of registration consists of the project <br />registration number from the state department of licensing and regulation. <br />(b) Where a construction improvement permitted through the City of San Marcos do not meet the valuation <br />threshold for reviews and inspections by a Registered Accessibility Specialist, the contractor will not be <br />exempted from compliance with Texas Accessibility Standards. <br />(C) It shall be a property owner's responsibility to maintain accessible features of construction and site <br />improvements. <br />( Ord. No. 2015-21, § 1, 7-7-15 ) <br />Sec. 14.011. Construction noise. <br />(a) It is unlawful for any person to cause construction noise to be made between 9:00 p.m. and 7:00 a.m. if the <br />noise can be heard from any public street or from a residence on private property in the City other than the <br />property on which the noise is made. <br />(b) This section does not apply to: <br />(1) Construction noise from construction activities performed by or for a governmental entity; <br />(2) Construction noise from emergency construction activities conducted solely to alleviate an imminent <br />danger to persons or property; or <br />(3) Construction noise from construction activities that are required in order for the installation or <br />performance of certain systems or subsystems to meet best practices of building construction. This <br />exception will apply only upon the Building Official's prior written approval. To obtain the Building <br />Official's approval a contractor must provide written certification from a licensed professional engineer <br />and any other information the Building Official determines is required to prove that the activity is <br />required for best practices.
