RESOLUTION 2008-38R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING A MEMORANDUM OF AGREEMENT <br />WITH THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY <br />AND OTHER LOCAL GOVERNMENTS RENEWING AN ORIGINAL <br />AGREEMENT TO LOCALLY ENFORCE MOTOR VEHICLE IDLING <br />LIMITATION RULES; AUTHORIZING THE INTERIM CITY <br />MANAGER TO EXECUTE THIS AGREEMENT ON BEHALF OF THE <br />CITY AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. On July 19, 2005 the City entered into a Memorandum of Agreement ("MOA") <br />with the Texas Commission on Environmental Quality ("TCEQ") and various other local <br />governments for the City's local enforcement of motor vehicle idling limitation rules. <br />2. The City wishes to continue its participation in the Local Early Action Compact in <br />order to promote and encourage clean air in the Austin-Round Rock MSA and to renew the <br />original MOA approved in 2005. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The attached MOA between TCEQ, the City and various other local <br />governments renewing the original MOA to locally enforce motor vehicle idling limitation rules <br />is approved. <br />PART 2. The Interim City Manager, Collette Jamison, is authorized to execute this <br />MOA on behalf of the City. <br />PART 3.
