BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The City Council finds and determines that the Project is required for <br />the preservation of the public health, safety and welfare and the public convenience <br />and necessity for the citizens of the City, and is for the public purpose of providing <br />better utility service to the citizens and better water quality maintenance for outfall water <br />that flows into the San Marcos River. <br />PART 2. The City staff is authorized and directed to proceed with and conclude <br />negotiations with the owners of real property interests needed in connection with the <br />Project, and to initiate and prosecute to conclusion proceedings in imminent domain to <br />acquire the remaining fee title to the Subject Property depicted on the map that is <br />attached hereto, and to take all other lawful action necessary and incidental to such <br />eminent domain proceedings. <br />PART 3. The following purchase of real property in connection with the Rio <br />Vista Terrace Subdivision Improvement Project is hereby approved: <br />All of Eddie V. Gray's interest in 1.378 acres of land, more or less, out of the <br />J.M. Veramendi League No. 2, as described in a series of deeds beginning in Volume <br />121, page 606 and Volume 183, Page 60 of the Official Deed Records of Hays County, <br />Texas; the parcel being purchased for the total price of $ 50,00.00 plus closing costs <br />in an amount not to exceed $1,500.00. <br />PART 4. The Interim City Manager, Collette Jamison, is authorized to execute <br />all necessary documents in connection with the purchase of the real property described <br />above on behalf of the City. <br />PART 5. All acts and proceedings done or initiated by the employees and <br />agents of the City for the acquisition of real property interests needed in connection <br />with the Project are hereby authorized, ratified, approved, confirmed, and validated and <br />declared to be valid in all respects as of the respective dates thereof with and in regard <br />to the owners from whom such rights are being acquired. <br />PART 6. If any portion of this Resolution, or the application of the same to any <br />persons or set of circumstances is for any reason held unconstitutional, void, or invalid, <br />the validity of the remaining portions of this Resolution shall not be affected thereby, it <br />being the intent of the City Council of the City of San Marcos, Texas in adopting this <br />Resolution that no portion thereof, or provisions or regulation contained herein shall <br />become inoperative or fail by reason of any unconstitutionality or invalidity of any other <br />portion hereof and all provisions of this Resolution are declared to be severable for that <br />purpose. <br />
