BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The City Council finds and determines that the Project is required for the preservation of the public health, safety and welfare and the public convenience and necessity for the citizens of the City, and is for the public purpose of providing better utility service to the citizens and better water quality maintenance for outfall water that flows into the San Marcos River. PART 2. The City staff is authorized and directed to proceed with and conclude negotiations with the owners of real property interests needed in connection with the Project, and to initiate and prosecute to conclusion proceedings in imminent domain to acquire the remaining fee title to the Subject Property depicted on the map that is attached hereto, and to take all other lawful action necessary and incidental to such eminent domain proceedings. PART 3. The following purchase of real property in connection with the Rio Vista Terrace Subdivision Improvement Project is hereby approved: All of Eddie V. Gray's interest in 1.378 acres of land, more or less, out of the J.M. Veramendi League No. 2, as described in a series of deeds beginning in Volume 121, page 606 and Volume 183, Page 60 of the Official Deed Records of Hays County, Texas; the parcel being purchased for the total price of $ 50,00.00 plus closing costs in an amount not to exceed $1,500.00. PART 4. The Interim City Manager, Collette Jamison, is authorized to execute all necessary documents in connection with the purchase of the real property described above on behalf of the City. PART 5. All acts and proceedings done or initiated by the employees and agents of the City for the acquisition of real property interests needed in connection with the Project are hereby authorized, ratified, approved, confirmed, and validated and declared to be valid in all respects as of the respective dates thereof with and in regard to the owners from whom such rights are being acquired. PART 6. If any portion of this Resolution, or the application of the same to any persons or set of circumstances is for any reason held unconstitutional, void, or invalid, the validity of the remaining portions of this Resolution shall not be affected thereby, it being the intent of the City Council of the City of San Marcos, Texas in adopting this Resolution that no portion thereof, or provisions or regulation contained herein shall become inoperative or fail by reason of any unconstitutionality or invalidity of any other portion hereof and all provisions of this Resolution are declared to be severable for that purpose.
