RESOLUTION NO. 2023-71R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING THE SUBMISSION OF FOUR SUBDIVISION SETTLEMENT PARTICIPATION FORMS TO THE OFFICE OF THE ATTORNEY GENERAL OF THE STATE OF TEXAS TO SECURE THE CITY'S PARTICIPATION IN SETTLEMENT OF ADDITIONAL CLASS ACTION LAWSUITS AGAINST OPIOID DISTRIBUTERS AND MANUFACTURERS, ALLERGAN, CVS, WALGREENS, AND WALMART, BEFORE THE DEADLINE OF APRIL 18,2023;AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO EXECUTE ALL DOCUMENTS NECESSARY FOR THE CITY TO PARTICIPATE IN THE SETTLEMENT; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City Council of the City of San Marcos previously approved the City's participation in certain initial settlements related to opioid abatement pursued by the Texas Attorney General's Office(AG). On December 15,2021,the City approved Resolution 2021-261R authorizing the submission of a subdivision settlement participation form to the AG to secure the City's participation in a class action lawsuit against multiple opioid distributors and manufacturers. 2. Since approval of the initial Resolution, the AG has announced four additional settlements pending court approval. These new settlements require their own subdivision participation forms signed by the City Manager. The purpose of this resolution is to grant signature authorization for these new forms. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The City Council of the City of San Marcos authorizes the submission to the Office of the Attorney General of the State of Texas of four subdivision settlement participation forms in the format attached hereto,to secure the City's participation in lawsuits and settlements of additional class action lawsuits against Opioid distributors and manufacturers known as Allergan, CVS, Walgreens, and Walmart. PART 2. The City Manager or her designee is authorized to execute all documents necessary related to participating in the lawsuits and the four settlements on behalf of the City. PART 3. This resolution shall become effective immediately from and after its passage. ADOPTED on April 4, 2023.
