FORSITH SURVEY, <br />ABSTRACT NUMBER 173, HAYS COUNTY, TEXAS AND BEING A PORTION OF COUNTRY <br />ESTATES DRIVE / HAYS COUNTY ROAD NUMBER 243, SAID ROAD HAVING BEEN <br />DEDICATED TO HAYS COUNTY IN VOLUME 266 PAGE 463 OF THE HAYS COUNTY <br />DEED RECORDS AND ACCEPTED BY HAYS COUNTY IN VOLUME 267 PAGE 155 OF THE <br />HAYS COUNTY DEED RECORDS AND BEING MORE PARTICULARLY DESCRIBED BY <br />METES AND BOUNDS AS FOLLOWS: <br />BEGINNING at cotton spindle found in the base of a 28" Live Oak for the south corner of this tract, the <br />south corner of that described as 248.711 acres in a deed from the San Marcos River Foundation, Inc to <br />the City of San Marcos dated August 13, 2018 and recorded in Hays County Instrument Number <br />18028923 in the Hays County Official Public Records, an angle point in the northwest line of that 2.00 <br />acre described in a deed from Holman -Farrar Holdings, LLC. to Jimmy Ray Fife Jr. Et ux dated January <br />16, 2020 and recorded in Hays County Instrument Number 20002349 in the Hays County Official Public <br />Records, and being in the southeast line of the aforerefenced Country Estates Drive; <br />THENCE leaving the PLACE OF BEGINNING as shown on that plat numbered 28144-22-1-b <br />dated December 20, 2022, as prepared for the City of San Marcos by Byrn & Associates, Inc. of <br />San Marcos, Texas and crossing Country Estates Drive N 59° 26' 48" W 65.57 feet to a to 1/2" <br />iron rod set with a plastic cap stamped `Byrn Survey" for the west corner of this tract being in the <br />northwest line of Country Estates Drive and being in the southeast line of that described as 3.032 <br />acres in a deed from Don C. Green et ux to Lawrence G. Kearney et ux dated February 27, 1998 <br />and recorded in Volume 1387 Page 190 of the Hays County Official Public Records; <br />THENCE with the common southeast line of the Kearney tract and the northwest line of Country Estates <br />Drive N 30" 33' 12" E 118.91 feet to a 1/2" iron rod found with a plastic cap stamped "Hayes" for <br />the south corner of that described as 3.032 acres in a deed from Charlene Viscardi Kearney to Richard S. <br />Kious and Rana Tobelmann dated April 6, 2018 and recorded in Hays County Instrument Number <br />18012108 in the Hays County Official Public Records <br />THENCE continuing with the common west line of Country Estates Drive being the east line of the <br />Kious and Tobelmann 3.032 acre tract the following two courses: <br />1.
