<br /> ARTICLE 1. IN GENERAL—TREATMENT OFANIMALS
<br /> Sec. G.0Q1. Definitions.
<br /> For the purposes of this chapter,words used in the present tense include the future,the singular number
<br /> includes the plural,and the plural the singular; reference to male gender includes the female, and references to
<br /> any person or animal without specifying gender includes both male and female;the word "shall"is mandatory and
<br /> directory wherever itioused inthis chapter.Other words defined are:
<br /> Adequatefood means food that provides a nutritionally complete diet for the animal being fed with said food
<br /> being free from mold,insect infestation, rancidity,or otherwise compromised in u manner that would be harmful
<br /> tothe animal.
<br /> Adequate shelter means a shelter that has at least a roof,three sides,a clean floor, is ventilated, is
<br /> constructed in a manner to protect an animal from inclement weather,including the provision of bedding when
<br /> necessary toprotect the animal from cold nrinclement weather.
<br /> After hours means after 5:00 p.m. and before 8:00 a.m. on weekdays,and anytime on weekends.
<br /> Animal means any living creature, except human beings, classified as a member of the Kingdom Animalia
<br /> including, but not limited to, domestic or wild mammals, birds, reptiles and fish.
<br /> Animal at large means any animal (excluding sterilized cats) not under restraint of a person who has care,
<br /> custody,possession or control of the animal either on or off the premises of the owner;that is found to be outside
<br /> a fence or enclosure on the property to which the animal belongs;or that is otherwise off the premises of the
<br /> owner of the animal or person with care, custody, possession,or control of the animal.
<br /> Animal control officer means a person designated by the City as an enforcement officer who is qualified to
<br /> perform such duties to enforce city ordinances and state laws pertaining to animals,and who holds a basic animal
<br /> cont/o|officer certification;also referred to as Animal Protection Officer.
<br /> Animal control agency means a municipal or county animal control office,or a state,county,or municipal law
<br /> enforcement agency,that collects, impounds,or keeps stray, homeless, abandoned,or unwanted animals.
<br /> Animal services manager means the person designated by the City of San Marcos as the manager of animal
<br /> services and the animal shelter.
<br /> Animal services and animal services facility means the City of San Marcos division handling animal matters
<br /> and the animal facility and all services related to the operation of that facility.
<br /> Animal shelter means a facility that collects, impounds, quarantines, or keeps stray, homeless,abandoned, or
<br /> unwanted dogs orcats.
