and County have entered into an Interlocal Agreement relating to subdivision regulation in the extraterritorial <br />jurisdiction of the City. <br />L. Franklin Mountain, as a Primary Owner pursuant to the Original Agreement, confirms that it desires to <br />remove the Tract from the Original Agreement, so that such land can be included in the SMART Amended and <br />Restated Development Agreement. The City agrees that removal of the Tract from the Agreement and inclusion <br />of the same in the SMART Amended and Restated Development Agreement is prudent and consistent with City's <br />long term strategic planning. The City and Franklin Mountain hereby agree, in the adoption of this Agreement, <br />by updating the definition of the Property, as described in Exhibit "A", and modifying the Development Plan, as <br />described in Exhibit "B," that no portion of the Tract will be located within the Property and, thus, Franklin <br />Mountain will no longer be subject to any rights or obligations associated with the Agreement, as it relates to the <br />Tract. Relatedly, the City confirms that, after the removal of the Tract from the Development Agreement, all <br />other rights and obligations relating to the Property, as herein defined, remain unchanged. <br />
