C. Notice to the Employee of proposed termination: Employee shall begiven written notice of the <br /> Council's intent to terminate Employee and the date of hearing to be conducted in an <br /> exSouhw* session of the Council at least ten (10) calendar days prior to such hearing and <br /> termination. Employee shall be given the opportunity to present evidence at the hearing in <br /> response to such proposed termination. Employee's failure tu appear atsuch ha8hn0 does <br /> not prohibit the Council from taking action to terminate Employee. Employee shall have the <br /> option iorequest @ public hearing. <br /> D. Resignation by Employee. <br /> In the event Employee voluntarily resigns her position with the City during the term of this <br /> Agreement, then Employee shall give the City 30 days' notice in odvanoe, unless the parties <br /> agree otherwise inwriting. <br /> Section 14: Severance <br /> A. Termination without cause: <br /> 1. The City will pay Employee 8 lump ounn cash payment for all base salary earned' earned <br /> unused vacation (the same oogeneral employees), earned UDUeed sick leave (up to 45 <br /> d3yS), and other benefits that were earned but UOuG8d as of the last day of active <br /> employment. <br /> 2. The City will pay the Employee 8 |Unnp sum cash payment equal to twelve (12) [nODthe <br /> base salary. <br /> 3. City shall provide medical, dental, life and vision iDnUn8nC8 atthe same [8t8 offered current <br /> active City employees for @ nnexinnunl of five years, after which time the annp/Oy8e would <br /> then beoffered benefits inaccordance with all other retired employees. <br /> 4. The payments outlined above are contingent upon 8 waiver and release 0f8|/ o|8innS <br /> against the City in 8 form acceptable tothe City. <br /> B. Termination for cause: In the event Employee is terminated for cause 88 defined in this <br /> document, the City shall have no obligation to pay the severance pay and severance benefits <br /> designated in this Agn*ennant, with the exception of earned unused vacation (the aerne as <br /> g0De[8/ employees), earned unused SiCh leave (up to45daya)' and other benefits that were <br /> earned but unused aenfthe last day ofactive employment. <br /> C.
