(1) The pens,stalls,or other facilities for keeping the livestock or fowl, excepting hens,other than fenced
<br /> open pastures that are at least one acre,are located so that the livestock or fowl cannot come within
<br /> 100 feet of any existing dwelling or business building owned, used,or maintained by any person other
<br /> than the keeper;
<br /> (2) No more than eight hens may be kept within residential areas of the city so long as any cage or coop is
<br /> located at least 30 feet from neighboring residences.All hens must be contained within the owner's
<br /> yard.This exception does not apply to roosters;
<br /> (3) The pens,stalls, or other facilities for keeping the livestock or fowl, other than fenced open pastures
<br /> that are at least one acre,are located so that the livestock or fowl cannot come within 500 feet of any
<br /> existing food service establishment or food processing establishment, regardless of ownership or
<br /> occupancy of the establishment;
<br /> (4) The fenced open pasture,which is at least one acre, has a means of preventing the livestock or fowl
<br /> from coming within 25 feet of any property line that abuts an existing residence;
<br /> (5) A student residing in a residence within the City of San Marcos is enrolled in bona fide program,such as
<br /> 4H or FFA may keep a single livestock animal,during one school year,as part of a bona fide project
<br /> related to their enrolment in the program.
<br /> (b) The keeping or causing to be kept any livestock,chickens,geese,ducks,guineas, pigeons, rabbits or my other
<br /> such animals in those areas appropriately permitted by the zoning ordinances of the city in pens or enclosed
<br /> areas in such a manner as to become offensive to other persons living nearby is hereby declared to be a
<br /> nuisance.
<br /> (c) It shall be unlawful for any person to park or leave standing any truck,trailer,or other vehicle that has been
<br /> used for the hauling of livestock, animals or fowl in the city limits when notified by an animal control officer
<br /> that such vehicle is creating a nuisance due to odors,gases or fumes. Upon such notification,the owner,
<br /> operator,driver or other person responsible for such vehicle shall move such vehicle to a location outside of
<br /> the city limits.
<br /> (d) All manure and other excrement shall be disposed of in such a manner as to prevent it from becoming
<br /> offensive to other persons living nearby. It shall be unlawful for any person to transport slop,garbage or
<br /> other refuse over any alley,street or highway within the corporate limits of the city for the purpose of
<br /> feeding hogs or swine within the city.

<br /> Sec. 6.075. Keeping of hogs or swine.
<br /> (a) It shall be unlawful for any person to keep any live hog within the city limits for a longer period than 24
<br /> hours.This does not apply to miniature swine.
<br /> (b) Subsection(a)of this section does not apply to animal shelters,veterinary establishments,government
<br /> agencies,exhibitions at the county facilities,or commercial animal establishments located on property zoned
<br /> for those purposes.Such establishments, however, must meet sanitation requirements and keep all animals
<br /> securely caged or penned.
