RESOLUTION NO. 2022-195R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING CHANGE IN SERVICE NO. 3 TO THE <br /> AGREEMENT WITH SMARTFORCE TECHNOLOGIES INC., FOR A <br /> NECESSARY PUBLIC SAFETY PROCUREMENT FOR THE RENEWAL <br /> OF A CRIMINAL JUSTICE INFORMATION SHARING PLATFORM FOR <br /> THE POLICE DPARTMENT IN THE ESTIMATED ANNUAL AMOUNT <br /> OF $22,500 FOR A TOTAL CONTRACT PRICE OF $72,500; <br /> AUTHORIZING TWO OPTIONAL ONE-YEAR RENEWALS; <br /> AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO <br /> EXECUTE THE CHANGE IN SERVICE AGREEMENT ON BEHALF OF <br /> THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, Section 252.022(a) of the Texas Local Government Code permits limited <br /> exemptions from competitive purchasing requirements, including (a)(2) exemptions for <br /> procurements necessary to preserve or protect the public health or safety of the municipality's <br /> residents and(a)(7) for items available from only one source; and <br /> WHEREAS, the City Council finds that the purchase authorized in this Resolution is one that is <br /> necessary to preserve or protect the public health or safety of the municipality's residents and is <br /> necessary from the contractor named below because they are the sole source of license renewals <br /> and extensions of products for products already in use by the City because of patents and <br /> copyrights; NOW THEREFORE, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. Change in Service No. 3 to the agreement with SMARTFORCE Technologies, <br /> Inc. (Contract No. 220-244), for a necessary public safety procurement for the renewal of a <br /> Criminal Justice Information Sharing Platform for the Police Department in the estimated annual <br /> amount of$22,500 bringing the total contract amount to $72,500, with up to two additional one- <br /> year renewals, is approved. <br /> PART 2. The City Manager or her designee is authorized to execute the Change in <br /> Service Agreement and any renewal documents on behalf of the City. <br /> PART 3. This resolution will be in full force and effect immediately from and after its <br /> passage. <br />
