ORDINANCE NO. 2023-47 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS AUTHORIZING THE INSTALLATION OF SPEED <br /> CUSHIONS IN BOTH DIRECTIONS IN THE 500 THROUGH 700 BLOCKS <br /> OF UHLAND ROAD (FROM MILL STREET TO IH-35 WEST ACCESS <br /> ROAD); AND INCLUDING PROCEDURAL PROVISIONS; AND <br /> PROVIDING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. Uhland Road is a two-way residential street. A traffic study indicates that the <br /> 85th percentile speed in the 500 to 700 blocks of Uhland Road is 38.8 miles per hour <br /> between Mill Street and IH 35 West Access Road, in excess of the posted speed limit of 30 <br /> miles per hour. <br /> 2. Such traffic conditions are not safe for residents and residents have petitioned <br /> the City to install speed cushions on said blocks of Uhland Drive. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The Recitals are hereby found to be true and correct and are adopted as the <br /> findings of the City Council. <br /> SECTION 2. Pursuant to Section 82.066 of the San Marcos Code, on the basis of such <br /> findings, the City Council hereby authorizes the installation of speed cushions in the 500 to 700 <br /> blocks of Uhland Drive (from Mill Street to IH 35 West Access). <br /> SECTION 3. The installation of signs providing notice of the presence of the speed <br /> cushions is also hereby authorized. <br /> SECTION 4. If any word,phrase,clause,sentence,or paragraph of this ordinance is held to <br /> be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br /> ordinance will continue in force if they can be given effect without the invalid portion. <br /> SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in conflict <br /> with this ordinance are repealed. <br /> SECTION 6. This ordinance shall be effective upon its adoption on second reading. <br /> PASSED AND APPROVED on first reading on June 6, 2023. <br /> PASSED,APPROVED AND ADOPTED on second reading on July 3, 2023. <br />
